'GA <br />0 inanca Yo...1. q..:... <br />An Ordinance. <br />Determining to proceed with the improvement of West 231st Street in the Vil- <br />lage of North Olmsted, by grading, draining and slagging the same. <br />Be it ordained by the Council of the Village of North Olmsted, state of <br />Ohio, three = fourths of all members elected thereto being present and coneurr <br />Section 1. That it is the intention of the Council and it is hereby de- <br />termined to proceed with the improvement of West 231st Street in the Village <br />of North Olmsted, by grading, draining and constructing a slag•.road -bed there <br />in accordance with the plans and specifications prepared by the Engineer and <br />file in the Clerk's office and Resolution No. 177 duly adopted on the 3d day <br />August, 1926, <br />Section 2. That all claims for damages resulting therefrom shall be <br />eially inquired into after the completion of the proposed improvement. <br />i <br />Section 3. That the following lots and lands shall be assessed for said <br />improvement as above determined, to -wit : - Each lot and parcel of land'&bound- <br />ing and abutting upon said improvement in proportion to the entire cost as th <br />foot frontage of each said lot and parcel of land is to the entire assessable <br />frontage. <br />Section 4. That the whole cost of said improvement less 1/50 thereof, and <br />the cost of intersection shall be assessed by,the foot front upon the lots a:d <br />lands bounding and abutting upon said Tlesto231st Street, which said lots and lands; <br />are hereby determined to be especially benefited by said improvement; and thelcost', <br />of said improvement shall include the expense of the preliminary and other suz'veys{ <br />or engineering, inspecting and legal expenses; of printing and publishing the <br />notices, the cost of construction; together with interest on bonds issued in a <br />ticipation of the collection of deferred assessments; all expenses in connection. <br />with.the issuing and selling such bonds, and all other necessary expenditures: <br />Section 5. That the assessments to be levied shall be paid in five (5) <br />annual installments, with-interest on deferred payments, provided that the <br />owner of any property assessed, amy at his option pay-such assessment in cash <br />within 30 days from and after the passage of the assessing ordinance, in which <br />case said cash assessment shall not include any item of interest upon bonds to <br />be issued in anticipation of the collection of deferred installments of assess- <br />ments. <br />Section 6. That the bonds of the Village of North Olmsted shall be.issu,d <br />in anticipation of the collection of the assess*ents by installments and in an' <br />amount equal thereto. <br />Section 7. That the remainder of the entire cost of said improvement not' <br />specially assessed, including the cost of intersection together with the cost <br />of any real estate or interest therein, purchased or appropriated and the ans <br />and dxpense of any appropriation proceeding therefor and the damage awarded any <br />(nvner of adjoining lands, and interest,thereon and the cost and expense of any <br />such awards, shall be paid out of the public service fund, or a fund provided <br />for such purpose, and in the manner provided bylaw. <br />Section 8. And the Clerk is hereby ordered and directed to advertise <br />for Aids according to'law and to report to council at its first meeting after <br />the date set for the opening said bids showing all bids received. <br />■ <br />
