That it is the intention of the Council and it is hereby <br />determined to proceed with the improvement of � Martin Drive <br />in the'Village of North Olmsted, <br />by grading, draining and slagging same. from Porter Road southerly to the <br />south line of land of Rose Meyer <br />and in accordance with the plans and specifications prepared by the.Engineer <br />and on file in the Clerkts office and Resolution No. 321 `duly adopted <br />on the 21 day ,of August 19'28 <br />Section 2. That all claims for damages resulting therefrom shall be <br />judicially inquired into after the completion of the proposed improvement. <br />Section 3. That the following 'lots and lands shall be assessed for <br />said improvement as above determined, to wit: Each lot and parcel of land <br />bounding and abutting upon said impr ovement "in proportion to the entire <br />cost as the assessable foot frontage of each said lot and parcel of land <br />is to the entire assessable frontage. <br />Section 4. That the whole cost of said improvement less one- fiftieth <br />(150) thereof, and the cost of intersection shall be assessed by the foot <br />front upon the lots and lands bounding and abutting upon said <br />Martin Drive which said lots and lands are hereby <br />deEermined to be especially benefited by said improvement; and the cost <br />of said improvement shall include the expense of the preliminary and other <br />surveys of engineering, inspecting and legal expenses; of printing and <br />publishing the notices; the cost of construction; together with interest <br />on notes and /or bonds issued in 'anticipation of the collection of deferred <br />assessments; all expenses in connection with the issuing and selling such <br />notes and/or bonds, and all' other necessary expenditures. <br />Section 5. That the assessments to be levied shall be paid in five <br />_ annual installments, with interest on deferred payments, pro - <br />vie t the owner of any property assessed, may at his option pay such <br />assessment in cash within thirty '(30) days from and after the passage of <br />the assessing Ordinance, in which case said cash assessment'shall not in- <br />elude any item of interest ,upon notes and/or bonds to be ,issued in anti- <br />C' cipation of the collection of deferred installments of assessments. <br />Section 6.. That the notes and /or bonds of the Village of North Olmsted <br />shall be issued in anticipation of the collection of the assessments Uy <br />installments and in an amount equal thereto. <br />Section 7. That the remainder of the entire cost of said improvement <br />not especially assessed, including: the cost of intersection together with <br />the cost` of any real estate or interest therein, purchased or appropriated <br />and the cost and expense of any appropriation proceeding therefor and the <br />damage awarded any myner of adjoining lands,.and interest thereon and the <br />cost and expense of any such awards, shall be paid out of the public ser- <br />vice fund or a fund provided for such <br />p purpose, and in the manner provided <br />by law.
