That it is the intention of the Council and it is hereby determined to proceed with the improvement of � Martin Drive in the'Village of North Olmsted, by grading, draining and slagging same. from Porter Road southerly to the south line of land of Rose Meyer and in accordance with the plans and specifications prepared by the.Engineer and on file in the Clerkts office and Resolution No. 321 `duly adopted on the 21 day ,of August 19'28 Section 2. That all claims for damages resulting therefrom shall be judicially inquired into after the completion of the proposed improvement. Section 3. That the following 'lots and lands shall be assessed for said improvement as above determined, to wit: Each lot and parcel of land bounding and abutting upon said impr ovement "in proportion to the entire cost as the assessable foot frontage of each said lot and parcel of land is to the entire assessable frontage. Section 4. That the whole cost of said improvement less one- fiftieth (150) thereof, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding and abutting upon said Martin Drive which said lots and lands are hereby deEermined to be especially benefited by said improvement; and the cost of said improvement shall include the expense of the preliminary and other surveys of engineering, inspecting and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on notes and /or bonds issued in 'anticipation of the collection of deferred assessments; all expenses in connection with the issuing and selling such notes and/or bonds, and all' other necessary expenditures. Section 5. That the assessments to be levied shall be paid in five _ annual installments, with interest on deferred payments, pro - vie t the owner of any property assessed, may at his option pay such assessment in cash within thirty '(30) days from and after the passage of the assessing Ordinance, in which case said cash assessment'shall not in- elude any item of interest ,upon notes and/or bonds to be ,issued in anti- C' cipation of the collection of deferred installments of assessments. Section 6.. That the notes and /or bonds of the Village of North Olmsted shall be issued in anticipation of the collection of the assessments Uy installments and in an amount equal thereto. Section 7. That the remainder of the entire cost of said improvement not especially assessed, including: the cost of intersection together with the cost` of any real estate or interest therein, purchased or appropriated and the cost and expense of any appropriation proceeding therefor and the damage awarded any myner of adjoining lands,.and interest thereon and the cost and expense of any such awards, shall be paid out of the public ser- vice fund or a fund provided for such p purpose, and in the manner provided by law.
