Ordinance No.,� <br />By Mr. <br />AN ORDINANCE !, <br />REQUIRING A PEFUIT FOR OPENING STREETS AND A DEPOSIT <br />TO PAY.THE COST OF REPAVING. <br />a <br />�i <br />BE IT ORDAINED by the Council of the Village <br />of North Olmsted,' State .of Ohio: <br />Section 1. No person, firm or corporation shall' <br />make any opening or remove any pavement in any streets, <br />boulevards, avenues or public places in the Village of I <br />North Olmsted until such person shall file with the Mayorj <br />of the Village a written or printed application setting <br />forth and indicating thereon the location;. kind and extent <br />Of the pavement desire&to be taken up, the number, purpose <br />and size of openings or excavations which are desired or l <br />necessary, The" applicant shall pay to the Village of <br />North Olmsted $3X0 for the General Fund before the permit <br />is issued and shall deposit with the Village an additional <br />amount sufficient to cover the cost of repairing and 're- <br />laying the said pavement to be removed, together with the l <br />cost of any new material required, plus fifteen per cent <br />(15 %) for the cost of inspection and general supervision, <br />as the same shall be estimated by the Mayor. <br />Section 2. After the deposit herein required <br />has been made, the Mayor shall issue the permit applied <br />for. Said permit shall state the exact time when the <br />opening or excavation is to be made, the probable length <br />of time required for doing the'work and the making of <br />the repair, the character of'the pavement, including its <br />base, and the character of the work .necessary for the <br />satisfactory relaying of the pavement. It shall be the <br />duty of the Village itself to relay the pavement, either <br />temporarily or permanently,as may be determined by the <br />Mayor. <br />Section 3. When such work is completed and the <br />Pavement relaid, the Mayor will determine the cost of the <br />work of relaying the pavement, together with the cost of <br />new materials required and the cost of inspection and <br />supervision, as the case may be, which amount shall be de <br />ducted from the deposit made by the applicant and the <br />Clerk shall issue a check to the applicant for the return <br />Of the excess over and above the amount necessary to re- <br />imburse the Village for the expense -of relaying the pave - <br />went, together with the,cost of new material and supErvision. c <br />Section 4. If the deposit be insufficient to <br />reimburse the Village, the Mayor shall collect from the <br />applicant a sufficient amount to reimburse the Village <br />o the expense incurred. <br />Section 5., Any person; firm or corporation <br />who shall make any :openings or remove the pavement in , <br />any street, boulevard, avenue or public ground of the <br />Village of ;North Olmsted without having first obtained <br />a permit from the Mayor and shall have deposited with <br />him the estimated cost of repairing Ysaid , work as'herein- <br />before set forth, - shall,' upon conviction thereof, be <br />fined not to exceed $50.00. <br />Section 6.
