Ordinance No. 746 <br />By Mr. <br />AN ORDINANCE <br />DETERMINING TO PROCEED WITH THE I1JPROVE1.IENT OF 1,JARION ROAD, <br />FROM . CLAGUE ROAD TO WEST 230th STREET, AND WEST 230th STREET, <br />FROM THE NORTH VILLAGE LINE TO CLItFFORD DRIVE, BY SURFACING <br />SAME WITH BITLT14INOUS IiACADAM. <br />BE IT ORDAINED by the Council of the Village of North <br />Olmsted, State of Ohio: <br />Section 1. That it is hereby determined to proceed with <br />the improvement of Marion Road, from Clague Road to hest 230th <br />Street, and West 230th Street, from the North Village Line to <br />Clifford Drive, by surfacing same with bituminous macadam.. in <br />accordance with Resolution No. 1523 passed on the 20th day of <br />July, 1948, and in accordance with the plans, specifications, <br />estimates and profiles heretofore approved and now on file in <br />the office of the Clerk. <br />Section 2. That all claims for damages resulting there - <br />from shall be judicially inquired into after the completion of <br />the proposed improvement, and the solicitor be, and he is hereby, <br />authorized and directed to institute proceedings:in a court of <br />competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall be <br />assessed by the foot front upon the following described lots <br />and lands, to wit, all lots and lands bounding and abutting upon <br />the proposed improvement, which said lots and lands are hereby <br />determined to be specially benefited by said improvement; and <br />the cost of said improvement shall include the expense of pre- <br />liminary and other surveys, of printing and publishing the <br />notices, resolutions and ordinances required, the serving of <br />said notices, the cost of construction, together with interest <br />On notes or bonds issued in anticipation of collection of 'de- <br />ferred assessments and all other, necessary expenditures. <br />Section 4. That the assessments so to be levied shall <br />0 Paid in five annual installments, with interest not to exceed <br />six <br />per cent per annum on deferred payments, provided that the <br />owner of any property assessed may, at his option, pay such <br />assessment in cash within thirty days from and after the passage <br />Of the assessing ordinance, in which case said assessment shall <br />not include any item of interest upon notes or bonds to be <br />issued in anticipation of the collection of deferred installments <br />of assessments. <br />Section 5. That notes or bonds of the Village of North <br />Olmsted shall be issued in anticipation of the collection of <br />assessments by installments and in an amount equal thereto. <br />Section 6. That'the remainder of the entire cost of said <br />improvement not specially assessed, including the cost of <br />intersections, shall be paid out of the General Fund or by the <br />Issuance of bonds of the Village of North Olmsted for that <br />Purpose, in the manner provided'by law. <br />Section 7. That the Clerk be, and he is hereby, author- <br />iZed and directed to advertise for bids for the construction of <br />said improvement according to law, <br />Section 8. This'ordinance is hereby declared to be an <br />emergency measure, the emergency being that it is necessary for <br />the immediate preservation of public health, peace, safety . and <br />welfare that this ordinance be passed at once and shall take <br />effect and be in force-from and after its .passage. <br />Passed September 7, 1948. <br />M ay o r <br />'n <br />
