Ordinance No. <br />By Mr. <br />AN ORDINANCE <br />DETERMINING TO PROCEED WITH THE IMPROVELIENT OF MbNMZIE ROAD, FROM <br />LORAIN ROAD TO THE SOUTHERLY LINE OF JOHN & 14ARY MARUSCHAK `PROPERTY, <br />BY CONSTRUCTING THEREIN A WATER 1QART . <br />BE IT ORDAINED by the Council" of the Village of North <br />Olmsted, State of Ohio: <br />I <br />Section 1. That it is hereby determined to proceed <br />with the improvement of McKenzie Road, . from Lorain Road -to' the <br />southerly line of John &'Mary Maruschak property, by constructing <br />therein a water main, : Ln accordance with Resolution No. 1644 passed <br />on the 6th day of June, 1950, and the petition of property owners <br />described in said resolution,, and in .accordance with the plans., <br />specifications, estimates and' profiles heretofore' approved and now <br />on file in the office of the Clerk.` <br />Section 2. That all claims for damages resulting <br />therefrom shall be judicially inquired Into after the completion <br />of the proposed improvement, and the solicitor be, and he is here - <br />by authorized` and directed to institute proceedings in a court of <br />competent jurisdiction to inquire into such, claims. , <br />Section' 3. ' ` Thatr the cost of said .improvement shall <br />be assessed .by_ the foot front upon the following described lots . <br />and lands, to wits all lots and lands bounding' and. abutting upon <br />the proposed improvement, which said lots and lands are hereby <br />determined to be specially benefited by said improvement; and the <br />cost of said improvement' shall include the expense of preliminary <br />and other surveys, of printing snd publishing the notices, resolu- <br />tions and ordinances required, the serving' of said notices, the <br />cost of construction, together with interest on notes or bonds <br />issued in anticipation of collection of deferred assessments and <br />all other necessary.expenditures. <br />Section 4. That the assessments so to be levied shall <br />be paid in ten annual Installments, with interest not to exceed <br />six per cent per annum on deferred payments; provided that the <br />owner of any property assessed may, at his option, pay such assess - <br />ment in cash within thirty` days from and after the passage of the <br />assessing ,ordinance, in which case said assessment shall not <br />Include any item of interest upon notes or bonds to be issued In <br />anticipation of the collection of deferred Installments of <br />- assessments., <br />Section 5. That notes or bonds of the Village of North <br />Olmsted shall' be issued in anticipation of the collection of <br />assessments by installments and in an' amount equal thereto. <br />Section 6.' That ' t)ae Village- Engineer be and he is hereby <br />directed to prepare and file with this council a tentative assess- <br />ment showing the amount to be assessed on each lot or parcel of <br />land to be assessed. <br />Section 7.' That the Clerk be, and he is hereby, <br />authorized and directed to advertise for bids for the .construction <br />of said improvement according to'law. <br />Section 8. This ordinance is hereby declared to-be, , <br />an emergency measure, the emergency being_ that it is necessary for <br />the immediate ' preservation of 1 public health.. , peace safety and <br />welfare that this ordinance be passed at once and shall take <br />effect and be in force from and after' its passage. <br />Passed: August 1, 1950. <br />lerk -� Mayor <br />
