JUNE 182 1957 - Fage 2 <br />Mr. PJeubauer stated I4r. r,Iorrison did clea.n out the ditch on the W. 231st <br />Street, Fairview City Line, but-they are still going to have trouble. <br />I?s. Joseph Frol.o stated that our drag line had cleaned out the DozTer Road <br />ditch to the Westlake line and the water lays there. ti°Testlake claims they <br />have no money to clea.n ditches. The Safety-Service Director stated that he <br />?Tould talk to 2layor Price and see if ti?,Iestlake will pay for the drag linc <br />when it gets there. <br />Ms. Schi-renkj, Chairman of the Properties Committee, stated that the Lair <br />Director explained about the hearing on the a.njunction on the Sanitary Land <br />Fi.ll. The Judge told the attorneys to settle the case bet,.een the parties.. <br />TheYwere justified as to dust, smol:e and noise. He suggested we landscape <br />it at Col.umbia Road and the 13.,000 residents of Plorth Olmsted had an ideal <br />location foz• the land fill. In regards to the anm.ers on the fifteen <br />suggestions on the operation of the Sanitary Land Fill the cor:mittee recomnends <br />as foZlows: <br />?l) The nearest possible access is fully developed with neir hoMes. P1o <br />other access is avaa.lable, except at long distances and purchase of <br />considerable property at great expense. <br />(2) The City wil.l su.rface the present roadway with additional slug ar:d <br />macadari to eliminate dust and noise, and properly maintain the same. <br />(3) The City rxust use the Land Fill through the daylight hours of 9:00 <br />t0 4:30, Monday through Saturday, and will endeavor to so limi.t such <br />access, except in cases of actual emergency. <br />(4) Suitable fence -vrill be erected on Coluribia Road side of La,nd Fi11 and <br />City intends to fence in the entire area as soon as funds are avai.lable. <br />(5) Portion of Land Fill now filled wi.ll be leveled and seeded with rye <br />grass or other suitable cover crop. Council feels it cannot cor.lmit <br />future Councils not to re-use portion suggested, but sincerely hopes <br />this wi7l not be necessary. <br />(6) Fast-growi.ng shrubs s,rill be planted along Columbia Road side of the <br />Zand Fill as rapidly as plantings wi.ll pei7nit. <br />\ <br />(7) Burning of burnable rubbish canziot be eliminated at the Land Fill sitep <br />but such burnings wi11 be made as far distant from the Columbia Road <br />homes as possible and will be kept to a minimum. <br />(8) Rubbish and refuye are now being covered @aily and tirill not be permi.tted <br />to remain uncovered overnight. <br />(9) This request is being fully complied with. <br />(10) This request is being fully conplied tAth, and at?y possible fli,ture <br />infraction will be appropriately deal.t with. <br />(11) This request is and will continue to be ftzlly complied with. <br />(12) Council cannot grant this request since it'has no right to attempt to control the discretion or judgment of future Councils. <br />(13 and 14) Council c2nnot make an4Y agreement as to the future use of the <br />Land Fill., but sincerely hopes that sometime in the future with the <br />possible erection of an incinerator somewhex•e in the western suburbs2 " <br />either with public or private capital? that the Land Fill might becone <br />unnecessary and could become a pla?,vground, if an incinerator is ever <br />built in the City it certainly would be properly landscaped or screened. <br />(15) This request will be strictly enforced. <br />A motion was made by I,1r. Decker, seconded by Mr. Kramer, to apprave the <br />recommendations of the Corranittee on the fifteen suggestions for the operation <br />of the Sanitary Land Fill* trYeas" Baker, Crider, Decker, Kramer, NSacDonaldp <br />Neubauer, Schwenk.
