CITY OF NORTH OLMSTED RESOLUTION NO. 2013— 112 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO A TWO-YEAR AGREEMENT WITH A & J DISTRIBUTION IN ORDER TO PROVIDE FOR VENDING AND VIDEO GAME MACHINES AT THE NORTH OLMSTED RECREATION CENTER, AND DECLARING AN EMERGENCY. WHEREAS, acting pursuant to the provisions of Section 111.01 of the North Olmsted Codified Ordinances, the Recreation Commissioner solicited proposals for a revenue generating contract for the purpose of providing vending and video game machines at the North Olmsted Recreation Center; and WHEREAS, the Administration is satisfied with the quality of the services that have been provided to the North Olmsted Recreation Center by A & J Distribution, a successor entity to Quality Quick Snacks, the previous contractor and, following evaluation of their proposal under Section 111.01, has recommended a two-year Agreement with the Board of Control; and WHEREAS, it is the desire of this Council, based upon the recommendation of the Board of Control, to enter an Agreement with A & J Distribution for a two-year period from January 24, 2014 through January 25, 2016; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY,AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a two- year Agreement with A&J Distribution, for the purpose of providing for Vending and Video Game Machines at the North Olmsted Recreation Center, for term of January 24, 2014 through January 25, 2016, in substantially the form and substance as the Agreement, a copy of which attached hereto as Exhibit A, with only such changes as may be determined necessary by the Director of Law to comply with law. SECTION 2: This Council finds determines that all formal actions of this Council and of any of its committees concerning and relating to the passage of this Ordinance were taken, and that all deliberations of this Council and of any committees that resulted in those formal actions were held, in meetings open to the public in compliance with the law.
