*spy <br /> CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2013 — 116 <br /> BY: Mayor Kennedy <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br /> CONTRACT WITH THE HOUSING RESEARCH ADVOCACY CENTER TO <br /> PROVIDE TESTING SERVICES RELATED TO COMPLIANCE WITH THE <br /> FAIR HOUSING LAWS OF THE CITY OF NORTH OLMSTED, AND <br /> DECLARING AN EMERGENCY. <br /> WHEREAS, the City requested proposals from firms qualified to perform testing for <br /> compliance with Fair Housing laws for properties available for rent within the City; and <br /> WHEREAS, two firms responded: Housing Research Advocacy Center ("HRAC") and <br /> Heights Community Congress; and <br /> WHEREAS, the Administration recommends that the City enter into a contract with <br /> HRAC to perform thirty (30) tests for two reasons: first, the price per test was $375.00 less per <br /> test with HRAC ($500.00) and second, Heights Community Congress was not fully responsive to <br /> the RFP; and <br /> **or <br /> WHEREAS, it is the desire of this Council to enter into a contract with HRAC to perform <br /> thirty (30) tests within the community, with said testing being paid for by funds provided by the <br /> United States government to the City of North Olmsted. <br /> NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, CUYAHOGA COUNTY,AND STATE OF OHIO: <br /> SECTION 1: That the Mayor be and he hereby is authorized to execute a contract with <br /> Housing Research Advocacy Center in substantially the form and substance as evidenced in the <br /> Agreement attached to this Ordinance as "Exhibit A," with only such changes to said contract to <br /> be hereinafter made as are not substantially adverse to the City and which are approved by the <br /> Director of Law. The character of any such changes as not being substantially adverse to the <br /> City shall be evidenced conclusively by the execution of the agreements by the Mayor and the <br /> approval of the agreements by the Director of Law. <br /> SECTION 2: That this Resolution is hereby declared to be an emergency measure <br /> immediately necessary for the preservation of the public health, safety, and welfare and for the <br /> further reason it is necessary that this legislation go into effect immediately in order that the City <br /> ensure compliance with anti-discrimination laws at the earliest possible time and further, <br /> provided it receives the affirmative vote of two-thirds of all members of the Council, it shall take <br /> effect and be in force immediately upon its passage and approval by the Mayor. <br /> 1 <br />
