CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2014-3 <br /> By: Mayor Kennedy <br /> A RESOLUTION DISPENSING WITH THE REQUEST FOR PROPOSAL <br /> ("RFP")PROCESS AND AUTHORIZING THE MAYOR TO ENTER INTO AN <br /> AGREEMENT WITH THE OHIO ATTORNEY GENERAL TO PERFORM <br /> DELINQUENT DEBT COLLECTION SERVICES, AND DECLARING AN <br /> EMERGENCY. <br /> WHEREAS, this Council has been advised that non-resident ambulance services are <br /> routinely billed but that delinquent debt for such services may be subject to cost effective collection <br /> services performed by the Ohio Attorney General's Office; and <br /> WHEREAS, the services provided by the Attorney General are unique, specialized and not <br /> capable of being easily reproduced by those entities within the private sector at a similar; and <br /> WHEREAS, this Council desires to enable the Mayor to certify such debt for collection by <br /> the Ohio Attorney General by authorizing this Agreement; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, CUYAHOGA COUNTY,AND STATE OF OHIO: <br /> SECTION 1: That the Mayor be and he is hereby authorized to execute all documents <br /> necessary to enroll the City of North Olmsted in a collection program sponsored by the Ohio <br /> Attorney General for the collection of non-resident charges for emergency medical services and <br /> ambulance transportation by the City of North Olmsted. Said documents shall be approved by the <br /> Director of Law, with only such changes thereto as are not substantially adverse to the City and <br /> which are approved by the Director of Law. The character of any such changes as not being <br /> substantially adverse to the City shall be evidenced conclusively by the execution of the agreement <br /> by the Mayor and the approval of the agreement by the Director of Law. <br /> SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest <br /> date provided for by law. That this Resolution is hereby declared to be an emergency measure <br /> immediately necessary for the preservation of the public health,safety and welfare,and for the <br /> further reason that the Agreement must be in effect to assist in collection efforts, including <br /> collection via garnishment of tax refunds issued for 2013 tax filings filed on or before April 15. <br /> 2014, and further provided it receives the affirmative vote of two-thirds of all members of <br /> Council, it shall take effect and be in force immediately upon its passage and approval by the <br /> Mayor. <br />
