II. ASSET TRANSFER <br /> The COUNTY purchased the equipment described in the Asset Transfer Form (the <br /> "Radios") on behalf of the CITY under the terms of the program documents and <br /> attachments. The COUNTY expended Two Thousand Five Hundred Sixty One <br /> Dollars and Sixty Five Cents ($2,561.65). The COUNTY agrees to transfer title and <br /> warranties to the CITY with each asset transfer. The parties agree that transfer to title to <br /> the Radios shall occur following completion of the Asset Transfer Form (Exhibit A) by <br /> representatives for the CITY and COUNTY. The COUNTY shall allow the CITY's <br /> representatives, including its auditors, access to COUNTY records concerning this <br /> agreement, in order to verify the value of the Radios purchased on the CITY's behalf. <br /> All Asset Transfer Forms related to the CITY have been signed by the CITY and the <br /> COUNTY. <br /> III. GRANT CONDITIONS <br /> The CITY shall: 1) Comply with all special and standard grant conditions set <br /> forth in the Attachment I and made part of this AGREEMENT; 2) Comply with Senate <br /> bill 9 (Ohio's homeland security and anti-terrorism legislation). <br /> The CITY agrees that the Radios will be used on a P25 Compliant 700/800 MHz system <br /> for full time primary police and fire communications. <br /> The CITY agrees to share any primary operational channels and mutual aid channels with <br /> any or all other communities in Cuyahoga County. <br /> By accepting the Radios, the CITY agrees to implement a fully operational 700/800 MHz <br /> communication system for primary use by police and fire emergency services within four <br /> (4) months of receipt of the Radios. <br /> The CITY further acknowledges that the inability to adhere to these conditions will <br /> disqualify the CITY's eligibility to receive the Radios and will require the return of such <br /> equipment to the COUNTY for reallocation. <br /> IV. AUDITS <br /> A. Access to records <br /> To the extent permitted by law, the COUNTY and the State of Ohio Emergency <br /> Management Agency authorized representatives, shall have access during <br /> business hours for the purpose of audit and examination of any books, papers, <br /> program site, staff, clients, and records of the CITY that are pertinent to the <br /> subject grant. The COUNTY shall provide the CITY with two (2) days advance <br /> written notice of intent to audit. <br /> B. Final Audit <br /> 1. Final audit of the CITY shall be made by the Auditor of the State at <br /> each level of local government in accordance with standard time <br /> schedules. The CITY agrees to cooperate with Federal, State, and local <br /> auditing requirements and comply with standards, procedures, and <br /> reasonable schedules whether the audit be general, full-scope, financial, <br />
