CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 — 27 <br />By: Mayor Kennedy <br />AN ORDINANCE ACCEPTING A DEED FROM DALE FOWLES, <br />EXECUTOR OF THE ESTATES OF ARTHUR O. FOWLES AND JEAN <br />FOWLES, BOTH DECEASED, DONATING LAND TO THE CITY OF <br />NORTH OLMSTED. <br />WHEREAS, the City was contacted by Gregory A. Huber, Esq., attorney for the estates <br />of both Arthur O. Fowles and Jean Fowles, inquiring whether the City of North Olmsted would <br />accept a donation of real estate that is adjacent to land currently owned by the City of North <br />Olmsted on Butternut Ridge Road (the current Oxcart Food Pantry); and <br />WHEREAS, the City conducted a survey, prepared a legal description and undertook a <br />preliminary title search to both identify the parcel and to ensure that the land was free of liens or <br />encumbrances; and <br />WHEREAS, the land at Permanent Parcel Number 235 -06 -012 is 4,572 square feet, or <br />105 acres; and <br />WHEREAS, it is the desire of this Council and the Administration to gratefully accept <br />the land hereinafter described as a generous donation from Mr. and Mrs. Arthur O. Fowles. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby authorize the Mayor to accept a deed of <br />conveyance from Dale Fowles, Executor of the Estate of Arthur O. Fowles, deceased, Medina <br />County Probate Court Case No. 2011 07 ES 00322 and Dale Fowles, Executor of the Estate of <br />Jean Fowles, deceased, Medina County Probate Court Case No. 2011 07 ES 00323 conveying the <br />property described on Exhibit A, attached hereto and incorporated herein as if fully rewritten. <br />SECTION 2: That the Mayor is directed to receive and record said deed. <br />SECTION 3: That the Clerk of Council is directed to correspond with Dale Fowles <br />conveying gratitude and appreciation of the Council and the Administration for the land <br />conveyed to the City. <br />SECTION 4: That this Resolution shall take effect and be in force from and after the <br />earliest date provided for by law. <br />r <br />1 <br />PASSED: Ci , ✓l' <br />First Reading: <br />Second Reading: <br />Third Reading: <br />Committee: 11,114, <br />
