CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 -37 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTIONS 1363.105 AND 1363.107 OF <br />CHAPTER 1363 OF THE REAL PROPERTY MAINTENANCE CODE <br />ENTITLED "VIOLATIONS" AND "MINOR NUISANCES" IN ORDER TO <br />PROVIDE FOR MINOR MISDEMEANOR CITATIONS AND PENALTIES <br />FOR UNABATED MINOR NUISANCES, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, the Real Property Maintenance Code primarily provides for fines and <br />criminal penalties in the event that Code violations persist and remain unabated following Notice <br />of Violation; and <br />WHEREAS, Building Officials have previously noticed that some Minor Nuisance <br />conditions, such as discarded materials (trash & debris), overgrown bushes and trees, weeds and <br />plant materials in excess of six (6) inches, and natural clippings or yard waste, which are also <br />subject to abatement by remedial actions of the City, are not adequately deterred by Notice of <br />Violation, especially in egregious cases, without immediate enforcement of fines; and <br />WHEREAS, additional Minor Nuisance conditions, such as trash can storage, inoperable <br />junk vehicle storage, hard surface parking, and major automotive repairs, which are not subject <br />to abatement by remedial actions of the City, are not adequately deterred by Notice of Violation, <br />especially in egregious cases, without immediate enforcement of fines; and <br />WHEREAS, Building Officials, under the direction of the Director of Planning & <br />Development, upon the advice of the Director of Law, recommend amendments to the Real <br />Property Maintenance Code in order to treat unabated Minor Nuisances as Minor Misdemeanors <br />upon a first offense and to subject continuous and persistent unabated Minor Nuisance to further <br />prosecution, as necessary and warranted; and <br />WHEREAS, this Council desires to amend Section 1363.105 of the Codified Ordinances <br />in order to adopt and enforce criminal penalties for Minor Nuisances as Minor Misdemeanors in <br />the City. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1363.105 of Chapter 1363 of the Real Property <br />Maintenance Code, which presently reads as follow: <br />1363.105 VIOLATIONS <br />
