CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2014 - 34 <br />By: Mayor Kennedy <br />A RESOLUTION DISPENSING WITH THE REQUEST FOR PROPOSAL <br />( "RFP ") PROCESSAND A UTHORIZING THE MA YOR TO ENTER INTO AN <br />AGREEMENT WITH ANTHEM BLUE CROSS AND BLUE SHIELD FOR <br />REIMBURSEMENT OF AMBULANCE AND EMERGENCY MEDICAL <br />SERVICES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Public Safety/Service has been advised by Anthem, Blue Cross <br />and Blue Shield, that the City's request for reimbursement of ambulance and emergency medical <br />services may be subject to service provider agreements in order to be reimbursed at the current rates; <br />and <br />WHEREAS, the City cannot possibly Request Proposals for the insurance services <br />reimbursement Agreement to compete with Anthem because the insurance is secured by the patient, <br />not by the City, and the City can only seek to be reimbursed by Anthem for services provided to its <br />insured; and <br />WHEREAS, this Council desires to enable the Mayor to enter into an Agreement for <br />insurance reimbursement with Anthem in the event that its insured are provided EMS services by the <br />City; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to execute all documents and <br />Agreements necessary to enable the City of North Olmsted to seek reimbursement from Anthem, <br />Blue Cross and Blue Shield, for charges for emergency medical services and ambulance <br />transportation by the North Olmsted Fire Dept. Said documents shall be approved by the Director of' <br />Law, with only such changes thereto as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor <br />and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that the Agreement must be in effect to qualify for current rates in collection efforts, <br />including insurance reimbursement from Anthem ;, and further provided it receives the affirmative <br />vote of two- thirds of all members of Council, it shall take effect and be in force immediately upon its <br />
