CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2014 - 45 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA FOR TO MAKE APPLICA TION <br />FOR, AND ENTER INTO A LEASE WITH, ALLSTATE CAPITAL FOR THE <br />PURPOSE OF SUPPLYING FITNESS EQUIPMENT FOR THE <br />RECREATION CENTER, AND DECLARING AN EMERGENCY. <br />WHEREAS, after assessment of need and close examination of equipment from various <br />vendors, the Recreation Commissioner solicited proposals from various vendors to provide <br />various health and fitness equipment, via lease, for the fitness area of the Recreation Center; and <br />WHEREAS, the lowest proposal of said equipment was received from Health and Fitness <br />Equipment Centers, with lease terms established by Allstate Capital, as set forth in Exhibit A; <br />and <br />WHEREAS, it is the recommendation of the Mayor that the City enter into a lease with <br />Allstate Capital to provide health and fitness equipment as detailed in the attached Exhibit A, at <br />the prices and terms and conditions set forth therein and as further set forth in terms established <br />in a formalized Lease Agreement, received after Application, with only such terms therein as are <br />not substantially adverse to the City and which are approved by the Mayor and the Director of <br />Law; and <br />WHEREAS, it is accordingly the desire of this Council, based upon the recommendation <br />of the Mayor, to authorize the Mayor to make application for, and enter into a lease with, Allstate <br />Capital to provide for the said equipment at said prices. <br />NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to make application for and <br />further enter into a lease with Allstate Capital to supply the City with equipment set forth in the <br />attached Exhibit. Said lease shall not be substantially adverse to the City and shall include only <br />financial terms consistent with the attached Exhibit. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reasons that it is necessary for this legislation to go into effect immediately in order that <br />the City (1) maximize savings in this leasing transaction; and (2) finalize and fully implement <br />said lease prior to commencement of construction of improvements at the Recreation Center; and <br />further provided it receives the affirmative vote of two- thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
