CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2014 - 47 <br />BY: Mayor Kennedy <br />A RESOLUTION A UTHORIZING THE MA YOR TO ENTER INTO A LEASE <br />AGREEMENT WITH EVERBANK COMMERCIAL FINANCE FOR THE <br />PURPOSE OFACQUIRING A JACOBSEN ECLIPSE 322 HYBRID GREENS <br />MOWER FROM BAKER VEHICLE SYSTEMS, INC. AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Springvale is in need of a replacement greens mower for proper <br />maintenance of the course; and <br />WHEREAS, the Jacobsen Eclipse 322 Hybrid Greens Mower is available on a four (4) <br />year lease at $9,310.45 per year, as calculated from a State Bid List price; and <br />WHEREAS, it is the recommendation of the Mayor that the City enter into a lease with <br />Everbank Commercial Finance to provide a Jacobsen Eclipse 322 Hybrid Greens Mower, at the <br />terms and conditions set forth in a formalized Lease Agreement attached as Exhibit A, with only <br />such terms therein as are not substantially adverse to the City and which are approved by the <br />Mayor and the Director of Law; and <br />WHEREAS, it is accordingly the desire of this Council, based upon the recommendation <br />of the Mayor, to authorize the Mayor to enter into a lease with Everbank Commercial Finance to <br />provide for the said equipment at said price. <br />NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into a lease with <br />Everbank Commercial Finance to supply the City with a Jacobsen Eclipse 322 Hybrid Greens <br />Mower. Said lease shall not be substantially adverse to the City and shall include only financial <br />terms consistent with the attached Exhibit A. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary for this legislation to go into effect immediately in order that <br />the City replace aging and vital equipment required to maintain Springvale Golf Course during <br />the summer months of 2014 when reliable equipment is essential to continued operations; and <br />further provided it receives the affirmative vote of two - thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
