CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 — 55 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 521.11 OF THE GENERAL <br />OFFENSES CODE IN ORDER TO ESTABLISH PENALTIES <br />RELATING TO THE DEPOSIT OF SNOW AND ICE ON THE <br />PROPERTY OFANOTHER WITHOUT PERMISSION TO DO SO. <br />WHEREAS, this Council, in response to complaints about the deposit of snow in <br />conjunction with snow removal, enacted amendments to Section 521.11 by and through <br />Ordinance No. 2007 -27; and <br />WHEREAS, this Council has been informed that, in the absence of a penalty <br />provision, citations cannot be issued for violation of Section 521.11; and <br />WHEREAS, this Council accordingly desires to establish penalty provisions for <br />the unlawful depositing of snow and ice upon public sidewalks, tree lawn areas and <br />driveway aprons, or otherwise upon the property of another, in order to protect the safety <br />of pedestrians during the winter season; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 521.11 of the General Offenses Code, which <br />presently reads as follows: <br />521.11 DEPOSIT OF SNOW, ICE AND SLUSH. <br />(a) No person, owner, tenant or person in charge of real estate acting either <br />individually or through an agent, employee or subcontractor, shall deposit snow, ice or <br />slush upon the property of another without permission. For purposes of this section, <br />"property of another" shall include tree lawn areas and driveway aprons that abut real <br />property owned by any other person, partnership, corporation or other legal entity, and <br />shall also include any public street and any public sidewalk. <br />(b) The prohibitions of this section shall not apply to street snow and /or ice <br />clearing operations conducted by the City of North Olmsted. <br />SHALL BE AMENDED, AND, AS AMENDED, SHALL READ AS FOLLOWS: <br />521.11 DEPOSIT OF SNOW, ICE AND SLUSH. <br />(a) No person, owner, tenant or person in charge of real estate acting either <br />individually or through an agent, employee or subcontractor, shall deposit snow, ice or <br />slush upon the property of another without permission.
