CITY OF NORTH OLMSTED ORDINANCE NO. 2014 — 55 BY: Mayor Kennedy AN ORDINANCE AMENDING SECTION 521.11 OF THE GENERAL OFFENSES CODE IN ORDER TO ESTABLISH PENALTIES RELATING TO THE DEPOSIT OF SNOW AND ICE ON THE PROPERTY OFANOTHER WITHOUT PERMISSION TO DO SO. WHEREAS, this Council, in response to complaints about the deposit of snow in conjunction with snow removal, enacted amendments to Section 521.11 by and through Ordinance No. 2007 -27; and WHEREAS, this Council has been informed that, in the absence of a penalty provision, citations cannot be issued for violation of Section 521.11; and WHEREAS, this Council accordingly desires to establish penalty provisions for the unlawful depositing of snow and ice upon public sidewalks, tree lawn areas and driveway aprons, or otherwise upon the property of another, in order to protect the safety of pedestrians during the winter season; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 521.11 of the General Offenses Code, which presently reads as follows: 521.11 DEPOSIT OF SNOW, ICE AND SLUSH. (a) No person, owner, tenant or person in charge of real estate acting either individually or through an agent, employee or subcontractor, shall deposit snow, ice or slush upon the property of another without permission. For purposes of this section, "property of another" shall include tree lawn areas and driveway aprons that abut real property owned by any other person, partnership, corporation or other legal entity, and shall also include any public street and any public sidewalk. (b) The prohibitions of this section shall not apply to street snow and /or ice clearing operations conducted by the City of North Olmsted. SHALL BE AMENDED, AND, AS AMENDED, SHALL READ AS FOLLOWS: 521.11 DEPOSIT OF SNOW, ICE AND SLUSH.
