CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 - 67 <br />BY: Council Members Schumann & Barker <br />AN ORDINANCE AMENDING SECTIONS 1363.302.13 OF CHAPTER 1363 <br />OF THE REAL PROPERTY MAINTENANCE CODE ENTITLED <br />"SUPPLEMENTAL REGULATIONS FOR RESIDENTIAL PROPERTY" IN <br />ORDER TO PROVIDE STANDARDS FOR MAINTENANCE OF <br />FIREWOOD, AS AMENDED. <br />WHEREAS, the Real Property Maintenance Code provides standards for the <br />maintenance of premises, including considerations for health, safety and general welfare of <br />neighboring property owners; and <br />WHEREAS, Building Officials have previously noticed that firewood storage is <br />occasionally the source of nuisance complaints, including proximity of storage, pest infestation <br />and volume; and <br />WHEREAS, additional maintenance standards regulating firewood storage will reduce <br />uncertainty and eliminate hazardous conditions; and <br />WHEREAS, this Council desires to amend Section 1363.302.13 of the Codified <br />Ordinances in order to adopt and enforce maintenance standard for firewood storage. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1363.302.13 of Chapter 1363 of the Real Property <br />Maintenance Code, which presently reads as follow: <br />1363.302.13 Supplemental regulations for residential property <br />a. Trash containers and receptacles <br />Trash containers shall be stored within garages or other buildings authorized for such purpose, or <br />so located, or hidden by landscaping, fencing or an enclosure, as to not be visible from the public <br />right of way; provided, however, that trash containers may be stored in side yard areas and <br />visible from the right of way so long as the containers have lids that are sufficiently sealed so as <br />to prevent animal or insect foraging and infestation, and are located immediately adjacent to the <br />residential structure. <br />b.
