CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2014 - 68 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A <br />RENEWED AGREEMENT WITH CUYAHOGA COUNTY JUVENILE <br />COURT IN CONNECTION WITH THE COMMUNITY DIVERSION <br />PROGRAM TO ADDRESS JUVENILE MISDEMEANOR AND STATUS <br />OFFENDERS IN THE CITY OF NORTH OLMSTED, AND DECLARING <br />AN EMERGENCY, AS AMENDED. <br />WHEREAS, Ohio Revised Code Chapter 2151 and the Rules of Juvenile Procedure give <br />general authority for the Cuyahoga County Juvenile Court to establish legal mechanisms to divert <br />complaints before they are filed for formal court action, while protecting the constitutional due <br />process rights of accused juveniles; and <br />WHEREAS, the Department of Public Safety desires to continue to promote and develop <br />the City's Community Diversion Program which addresses juvenile misdemeanor and status <br />offenders, in conjunction with the North Olmsted Police Department and under the direction of <br />said Court, in order to divert youths, who are juvenile offenders involved with misdemeanor or <br />status offenses, from formal court action; and <br />WHEREAS, the City's Department of Public Safety and Community Youth Diversion <br />Program has been very successful in working with the Juvenile Court for several years and has <br />been awarded $12,000 in diversion service funding for 2015 without matching fund obligations <br />upon the City of North Olmsted; and <br />WHEREAS, this Council desires to enter into a renewed Agreement with the Cuyahoga <br />County Juvenile Court to assist the City in addressing juvenile misdemeanor and status offenses, <br />and to provide for and enable the City to utilize the financial assistance provided by said <br />Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into a renewed <br />Agreement with the Cuyahoga County Juvenile Court to assist the City in addressing juvenile <br />misdemeanor and status offenses and to request financial assistance in connection with a <br />Community Diversion Program established by the Cuyahoga County Juvenile Court., a Copyf <br />meets hefeby approved. Said contract shall be substantially in the form of the <br />"Community Diversion Prollram Agreement," marked as Exhibit "A" and attached hereto, <br />with only such changes therein as are not substantially adverse to the City and which are <br />approved by the Director of Law.
