Also as has been the case for the past, unless otherwise agreed at the outset, our fees for legal services in special counsel matters you refer to us from time to time will be determined on the basis of the customary hourly rates of the attorneys and non - attorney personnel involved in providing the services and the actual time expended. Our standard hourly rates for associates, partners and non - attorney personnel throughout the United States currently range from $130 for new associates to $1,150 or higher for some of our most senior partners and from $80 for new project assistants to $420 for experienced senior paralegals, with most non - attorney billing rates falling within the range of $80 to $315. In addition, before beginning work on a project or a particular phase of a project that we are requested to perform, we will be pleased to provide an estimate of our fees for that project or phase. That estimate will be based upon the size and anticipated complexity of the task. We will plan to bill you for our bond counsel services at or promptly following the closing of each financing transaction (or upon its abandonment if it does not proceed to a closing), for disclosure counsel fees annually upon completion of the City's annual information filing, for election counsel services promptly following the election and monthly for other special counsel services. We wish to confirm that, in rendering all such legal services, as an independent contractor and in an attorney client relationship, that Firm shall not exercise any administrative discretion on behalf of the City in the formulation of public policy, expenditure of public funds, enforcement of laws, rules and regulations of the City or of the State or any other public body, or the execution of public trusts.
