CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2014 — 72 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO <br />CONSENT AND COOPERATION CONTRACTS WITH THE STATE OF <br />OHIO, DEPARTMENT OF TRANSPORTATION, AS NECESSARY, ON <br />BEHALF OF THE CITY OF NORTH OLMSTED, TO GRANT <br />AUTHORIZATION FOR PUBLIC HIGHWAY SIGN REPLACEMENT ON <br />INTERSTATE 480 INCLUDING THE STATE ROUTE 10 INTERCHANGE, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the State of Ohio, Department of Transportation (ODOT) plans to construct <br />public safety improvements in 2015, specifically highway sign replacement, on Interstate 480 <br />including the intersection of State Route 10 (SR 10); and <br />WHEREAS, ODOT requests that the City of North Olmsted authorize, consent, <br />cooperate and perform maintenance with the highway sign project, on standard ODOT forms, <br />but does not require financial contribution or matching funds from the City; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into contracts with ODOT, on behalf of the City of North Olmsted, in order to authorize <br />highway sign improvement project activities within the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby authorize the Mayor to enter into contracts <br />with the Director of the Ohio Department of Transportation (ODOT) for its highway sign <br />replacement project, on behalf of the City of North Olmsted, as described to include <br />approximately 0.20 miles of SR 10 within the City, as scheduled for the 2015 construction <br />season, in order to signify the authorization, consent and cooperation of the City of North <br />Olmsted for sign replacement on 1 -480 at the SRI interchange; does further to acknowledge the <br />City's maintenance of municipal right -of -way, to keep such city streets open and free of <br />obstruction, and to hold same inviolate for public highway purposes. <br />SECTION 2: That the City of North Olmsted hereby grants consent to ODOT to <br />complete the described project, being in the public interest, and will cooperate with the Director <br />to construct improvements, with the stipulation that no funds are required from the City for the <br />highway sign replacement except that the City agrees to bear the entire costs, including added <br />construction items, if any, for any additional improvement items specifically requested by the <br />City and if such additional items are not necessary for the improvements as determined by <br />ODOT and the Federal Highway Administration. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that ODOT <br />may make immediate commitments to meet project schedules; and further, provided it receives <br />
