NOW, THEREFORE, Declarant, as owner of the Property, for himself, his successors and <br />assigns, declares as follows for his Amended Declaration of Restrictions: <br />That the paragraphs captioned "First" and "Second" in the Original Declaration of <br />Restrictions, be and the same are amended as follows: <br />1. The paragraph captioned FIRST, which presently reads as follows: <br />FIRST: That the Property shall be used exclusively for a parking jot as an accessory use to <br />the adjacent parcels to the south fronting upon Lorain Road and there shall not be erected <br />upon the Property any 'building. This First Restriction is made for the benefit of the City of <br />North Olmsted, Ohio, and the owners of property adjacent to the Property." <br />shall be amended in its entirety and as amended shall read as follows: <br />FIRST: That the Property shall be used exclusively for a parking lot as an accessory use to <br />the adjacent parcels to the south fronting upon Lorain Road and there shall not be erected <br />upon the Property any 'building. This First Restriction is made for the benefit of the City of <br />North Olmsted, Ohio, and the owners of property adjacent to the Property. This provision <br />shall be suspended so long as Declarant, his successors, assigns and heirs commences, <br />completes and uses the Property in strict conformity with the Development Plan approved <br />by the City of North Olmsted, City Council on the day of Ocxa-`�)t(� , 2014. Should <br />Declarant, his successors, assigns and heirs fail within one (1) year of the date the City of <br />North Olmsted City Council approved the Development Plain to commence the Development <br />Plan as evidenced by the application for building permits, or should Declarant, his successors, <br />assigns and heirs fail to complete, within one (1) year of the issuance of building permits, the <br />Development Plan as evidenced by issuance of a Certificate of Occupancy, or should <br />Declarant, his successors, assigns and heirs fail to use the property consistent with the <br />Development Plan approved by the City of North Olmsted, City Council on the r day of <br />W 0��)- 2 -' 2014, then the restrictions set forth herein and in the Declaration of <br />Restrictions shall be of full force and effect. <br />2. The paragraph captioned SECOND, which presently reads as follows: <br />SECOND: That no drive, driveway or roadway will be installed, constructed or built on the <br />Property at its boundary with Silverdale Road, North Olmsted, Ohio, and that no vehicular access <br />will be permitted directly from the Property to Silverdale Road. This Second Restriction is <br />likewise made for the benefit of the City of North Olmsted and the owners of property adjacent <br />to the Property. <br />shall be amended in its entirety and as amended shall read as follows: <br />SECOND: That no drive, driveway or roadway will be installed, constructed or built on the <br />
