Council Minutes of 09 -16 -2014 <br />District Court. This was an attempt by the City to eliminate three of Mr. <br />Bielozer's assertions of fraud, breach of contract and promissory estoppel at the <br />earliest stage of litigation. The City's efforts were successful, and those three <br />claims have been dismissed. Twelve total counts remain. The City has asked the <br />Court for an order requiring Plaintiffs to more definitely state their claims as the <br />City believes they aren't sufficient in detail on their face to enable to the City to <br />prepare an answer as to the truth of the matter set forth therin. Depositions of the <br />named Plaintiffs are being scheduled for October. After that, the City would be <br />moving for judgment on a number of different theories on the remaining claims <br />with the hope that the case would be eliminated in its entirety before it ever goes <br />to trial. <br />• Two additional days of arbitration are scheduled in the matter of former Police <br />Officer Bielozer's grievance re arding his termination. Those dates are <br />September 22nd and September 25 'P, . There may be additional dates scheduled. <br />• The Law Dept. prepared a brief of appellee in the matter of Brian Bielozer vs. the <br />City of North Olmsted Civil Service Commission and is awaiting a ruling from the <br />Court. <br />• In the arbitration arising from the termination of former Police Officer Fox, <br />evidence has been taken, both sides have submitted briefs and they anticipate a <br />ruling before the next Council meeting. <br />• He announced the passing of Mayor Kennedy's former Administrative Assistant, <br />Jane Leaver. She started at the beginning of Kennedy's first term but left after <br />being diagnosed with cancer. She fought valiantly and with great courage and <br />passed away two weeks ago today. He was honored to have her has a friend and <br />misses her greatly. He asked for a moment of silence. <br />Director of Finance Copfer: <br />• The 2013 audit was released by the Auditor of State on Tuesday September 9, <br />2014. <br />• The CAFR is now available on the City's website. The PAFR — Popular Annual <br />Financial Report — was published and delivered to the post office on Friday and <br />should be delivered to residents any day now. This is also available on the City's <br />website. <br />• She provided information and updates to Squires, the City's Bond Counsel, for <br />the annual information to be filed by the end of September. Further review and <br />revisions will be required. <br />• She and Human Resources Director Farver are attending a five -day course over <br />the next five Wednesdays through a scholarship from the State of Ohio that is a <br />collection of principles and methods that focus on the identification and <br />elimination of non -value added activity in any process. This can create a more <br />streamlined process and allow staff time to be focused on other mission - critical <br />activities. They are looking forward to attending. <br />• She gave Council a chart today from the CAFR regarding the tax rates that shows <br />the millage for the property tax rates and the allocation for the particular purposes <br />for Resolution 2014 -59 that's accepting the 2014 rates. This shows the same <br />apportionment of those city tax rates since 2010. <br />1) <br />
