CITY OF NORTH OLMSTED ORDINANCE NO. 2014 - 75 BY: Mayor Kennedy AN ORDINANCE AMENDING SECTION 353.07 OF THE TRAFFIC CODE OF THE CITY OF NORTH OLMSTED ENTITLED "PARKING TICKET PROCEDURES" IN ORDER TO CHANGE THE MISDEMEANOR CLASSIFICATION FOR FIRE LANE VIOLATIONS FROM A FOURTH DEGREE MISDEMEANOR TO A MINOR MISDEMEANOR. WHEREAS, the Traffic Code presently establishes jurisdiction to administer and prosecute Traffic Code Violations, specifically Fire Lane Parking Tickets, within the North Olmsted Mayor's Court; and WHEREAS, the current procedure permits a fire lane parking ticket to be paid at the Police Station within forty -eight (48) hours in the fine amount of fifteen dollars ($15.00). After forty -eight (48) hours and before the ticket is referred to the Mayor's Court, the fine amount increases to twenty -five dollars ($25.00); and WHEREAS, Fire Lane Parking Tickets are classified as fourth degree misdemeanors, subject to thirty (30) days in jail and not more than a two hundred and fifty dollar ($250.00) fine. Such offenses cannot be addressed through the Mayor's Court waiver schedule and require an appearance in Court; and WHEREAS, it is the recommendation of the Administration that Section 353.07 of the Traffic Code of the City of North Olmsted entitled "Parking Ticket Procedure" be amended to make the offense of Fire Lane Parking a minor misdemeanor offense, subject to the Mayor's Court and Rocky River Municipal Court waiver schedules; and WHEREAS, it is the desire of this Council, consistent with the recommendations of the Administration, to make the offense of parking in a fire lane a minor misdemeanor violation. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That section 353.07 of the Traffic Code which presently reads as follows: 353.07 PARKING TICKET PROCEDURES. (a) Parking tickets shall be written on a pre- printed form approved by the Chief of Police, which shall include all information necessary to identify the motor vehicle in violation and its registered owner.
