CITY OF NORTH OLMSTED ORDINANCE NO. 2014 — 77 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR TO REQUEST PROPOSALS FOR PLUMBING, HEATING, VENTILATION AND AIR CONDITIONING PREVENTATIVE MAINTENANCE SERVICES FOR THE CITY'S DIVISION OF RECREATION, FURTHER AUTHORIZING THE MAYOR, SUBJECT TO APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO AN AGREEMENT WITH THE CONTRACTOR SELECTED IN THE RFP PROCESS. WHEREAS, the current contract for preventative maintenance services on the plumbing, heating, ventilation and air conditioning ( "HVAC ") systems in the Division of Recreation is scheduled to terminate in March, 2015; and WHEREAS, the Mayor has requested that this Council authorize him, pursuant to the provisions of Chapter 112 of the City of North Olmsted Codified Ordinances, to initiate a new RFP process to select for a new term the most qualified corporation, firm or individual to provide preventative maintenance services for the City's plumbing and HVAC systems within the Division of Recreation; and WHEREAS, in accordance with the recommendation of the Mayor, it is the desire of this Council to so authorize the Mayor to request proposals from corporations, firms or individuals qualified to provide such preventative maintenance services for the City's plumbing and HVAC systems within the Division of Recreation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to request proposals from firms qualified to provide plumbing and HVAC maintenance services for the Division of Recreation in accordance with the Request for Proposals prepared by the Mayor. A copy of said Request for Proposals is on file in the office of the Mayor. SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board of Control, to enter into an agreement or agreements with the firm selected in the RFP process. Said agreement shall be in a form that is not substantially adverse to the City and which is approved by the Director of Law. The character of any content not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
