During the probationary period, discipline, suspension or discharge by the Employer, <br />shall not be subject to the Grievance Procedure. <br />If an employee is discharged or resigns during the probationary period described in the <br />aforementioned Section of this Article, and is later rehired, he shall be considered as a new <br />employee and subject to all terms contained within this Agreement. <br />ARTICLE XXXVI PERSONNEL RECORDS <br />36.1 The Employer shall maintain an individual official personnel file for each employee. The <br />official personnel file shall be located in the Department of Human Resources. Employees shall <br />be permitted to inspect their individual personnel file during regular business hours (8:00 a.m. — <br />4:00 p.m.; Monday through Friday, excluding Saturdays, Sundays and Holidays) by giving <br />reasonable notice and request to inspect said individual personnel file to the Director of Human <br />Resources. Should the Director of Human Resources not be available at the requested time, he <br />shall schedule a time mutually agreeable between himself and the employee. During the <br />inspection of the official file, the employee may have one (1) representative present. The <br />Employer may have one (1) representative present at the time the official personnel file is being <br />inspected by the employee. <br />36.2 Subject to the provisions of Ohio's public records laws, only the Director of Human <br />Resources, Fire Chief and the employee shall have access to the personnel file, except other City <br />Officials may have access and inspect the personnel file as needed to perform the functions of <br />their office. <br />ARTICLE XXXVII LABOR MANAGEMENT COMMITTEE <br />37.1 In the interest of sound Labor /Management relations, unless mutually agreed otherwise, <br />once each quarter on a mutually agreeable day and time, up to three (3) of the Employer's <br />Representatives shall meet with up to three (3) Association Representatives to discuss pending <br />problems or issues of concern and to promote a more harmonious Labor /Management <br />relationship. The Mayor shall be present when his participation is necessary to resolve an agenda <br />item. <br />37.2 An agenda will be furnished upon request of either party at least seven (7) days in <br />advance of the scheduled meetings with a list of the matters to be taken up in the meeting, and <br />the names of those Association representatives and management representatives who will be <br />attending. <br />37.3 It is further agreed that if special Labor /Management meetings have been requested, and <br />mutually agreed upon, they shall be convened as soon as feasible. <br />ARTICLE XXXVIII SAFE MINIMUM STAFFING <br />38.1 The City and Union shall establish a Fire Department Safe Minimum Staffing committee <br />to develop an implementation plan on how to raise the daily minimum safe staffing levels of line <br />31 <br />
