agrees that all utility accommodation, relocation and reimbursement will comply with the current <br />provisions of 23 CFR 645 and the ODOT Utilities Manual. <br />SECTION 4: Maintenance: Upon completion of the Project, and unless otherwise <br />agreed, the City shall: (1) provide adequate maintenance for the project in accordance with all <br />applicable State and Federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) <br />provide adequate financial provisions, as necessary, for the maintenance of the project; (3) <br />maintain the right -of -way, keeping it from obstructions; and (4) hold said right -of -way inviolate <br />for highway purposes. <br />SECTION 5: The Mayor be and he is hereby authorized to enter into all agreements with <br />the Director of Transportation necessary to complete the above described project. <br />SECTION 6: That this Resolution is hereby declared to be an emergency measure <br />inunediately necessary for the preservation of the public health, safety and welfare, and, <br />additionally, it is necessary that this Resolution go into effect immediately in order to implement <br />and complete the construction process during the construction season in 2015, and provided it <br />receives the affirmative vote of two - thirds of all members of Council, then it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor. <br />r' <br />PASSED: <br />ATTEST. <br />,MARIE GALLO <br />Clerk of C o until <br />APPROVED: ­21 sue/ I <br />MAY" R KEVIN M.
