CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2015—33 <br /> By: Mayor Kennedy <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br /> CONTRACT WITH MAD BOMBER FIREWORKS PRODUCTIONS TO <br /> PROVIDE A FIREWORKS DISPLAY FOR THE 2015 NORTH OLMSTED <br /> FOURTH OF JULY BICENTENNIAL CELEBRATION, AND DECLARING <br /> AN EMERGENCY. <br /> WHEREAS, the City of North Olmsted in 2015 is celebrating its bicentennial; and <br /> WHEREAS, the City of North Olmsted, in the 1970's and 1980's, had a long tradition of <br /> orchestrating a 4th of July fireworks celebration; and <br /> WHEREAS, the 4th of July fireworks celebrations in years past fostered a sense of <br /> community pride and served as a family friendly way to celebrate the holiday; and <br /> WHEREAS, to celebrate its bicentennial, foster community pride and provide a family <br /> friendly way to celebrate the 4th of July weekend in 2015, it is the recommendation of the <br /> Director of Planning and Development that the City enter into a contract with Mad Bomber <br /> Fireworks Production to provide a fireworks display for the 4th of July celebration in 2015. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, COUNTY OF CUYAHOGA,AND STATE OF OHIO: <br /> SECTION 1: That the Mayor be and he hereby is authorized to enter into an agreement <br /> with Mad Bomber Fireworks Productions to provide a fireworks display for the City of North <br /> Olmsted for the 5th of July, 2015. The contract shall be in form and substance substantially <br /> similar to the attached Mad Bomber Productions Agreement, marked as Exhibit A, and attached <br /> hereto, with such changes to be hereinafter made in said contract as are not substantially adverse <br /> to the City and which are approved by the Director of Law. The character of any such changes as <br /> not being substantially adverse to the City shall be evidenced conclusively by the execution of <br /> the Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br /> SECTION 2: That this Resolution is hereby declared to be an emergency measure <br /> immediately necessary for the preservation of the public health, safety and welfare, and further <br /> for the reason that it is necessary that this Resolution go into effect immediately in order to <br /> secure this contract for a time when the services of the contractor are in extremely high demand; <br /> and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br /> shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
