constitutional and statutory requirements. Therefore, both the Employer and the OPBA hereby <br /> reaffirm their commitment, legal and moral, not to discriminate in any manner relating to <br /> employment on the basis of race, color, religion, national origin, disability, sex or age. The <br /> OPBA shall share equally with the Employer, the responsibility for applying this provision of the <br /> Agreement. The OPBA and all collective bargaining unit members shall not discriminate against <br /> any person or persons, in any manner relating to their employment on the basis of race, color, <br /> religion, national origin, marital status, political affiliation, disability, sex or age. "Sex" includes <br /> a prohibition against sexual harassment. <br /> SECTION 2: The Employer agrees not to interfere with the rights of employees to become <br /> members of the OPBA, and there shall be no discrimination, interference, restraint or coercion <br /> by the Employer or OPBA against any employee because of OPBA membership, or lack of <br /> OPBA membership. <br /> SECTION 3: The OPBA and the Employer recognize the right of all employee(s) to be free to <br /> join or not join the OPBA and shall not coerce employee in any manner to join or not join the <br /> OPBA. <br /> ARTICLE 6: <br /> NO STRIKE/NO LOCKOUT <br /> SECTION 1: Neither the OPBA nor any employee shall directly or indirectly call, sanction, <br /> encourage, finance, participate, or assist in any way in any strike, slowdown, walkout, concerted <br /> "sick leave" or mass resignation, work stoppage or slowdown, or other unlawful interference <br /> with normal operations of the Employer for the duration of this Agreement. A breech of this <br /> Section may be grounds for discipline. The OPBA shall not be held liable for the unauthorized <br /> activity of the employees it represents or its members who are in breach of this section, provided <br /> that the OPBA meets all of its obligations under this Article. <br /> SECTION 2: The OPBA shall, at all times, cooperate with the Employer in continuing <br /> operations in a normal manner and shall actively discourage and attempt to prevent any violation <br /> of the "no-strike" clause. <br /> In the event of a violation of the "no-strike" clause, the OPBA shall promptly notify all <br /> employees in a reasonable manner that the strike, work stoppage or slowdown, or other unlawful <br /> interference with normal operations of the Employer is in violation of this Agreement, unlawful <br /> and not sanctioned or approved by the OPBA. The OPBA shall advise the employees to return to <br /> work immediately. <br /> SECTION 3: The Employer shall not lock out any employees for the duration of this <br /> Agreement. <br /> 3 <br />
