given written notice regarding the reasons(s) for the disciplinary action. The employee shall be <br /> informed of the right to confer with a representative of the OPBA. <br /> SECTION 3: Prior to any discipline being imposed, the employee shall be given the <br /> opportunity to appeal through Step 3 of the grievance procedure contained in Article 10 of this <br /> agreement. The employee shall then be able to appeal the Step 3 decision to arbitration, as set <br /> forth in Article 10 of this agreement. <br /> ARTICLE 10: <br /> GRIEVANCE PROCEDURE <br /> SECTION 1: Grievant - The "grievant" shall be defined as any employee, group of employees <br /> or the OPBA. <br /> Party in Interest - A "party in interest" shall be defined as any employee of the Employer <br /> named in the grievance who is not the grievant. <br /> Days - A "day" as used in this procedure shall mean calendar days, excluding Saturdays, <br /> Sundays or Holidays as provided for in this Agreement. <br /> SECTION 2: A grievance is a dispute regarding only the interpretation and application of this <br /> Agreement. <br /> A grievance can be initiated by the OPBA or an aggrieved bargaining unit employee. <br /> Where a group of bargaining unit employees desires to file a grievance involving a situation <br /> affecting each such bargaining unit employee in the same manner, one bargaining unit employee <br /> selected by such group shall process the grievance(s). <br /> SECTION 3: The following procedures shall apply to the administration of all grievances filed <br /> under this procedure. <br /> a) Except in Step 1, all grievances shall include the name and position of the grievant, the <br /> identity of the provisions of this agreement involved in the grievance; the time and place <br /> where the alleged events or conditions giving rise to the grievance took place, the identity of <br /> the party responsible for causing the said grievance, if known to the grievant; and a general <br /> statement of the nature of the grievance and the redress sought by the grievant. <br /> b) Except at Step 1, all decisions shall be rendered in writing at each step of the grievance <br /> procedure. Each decision shall be transmitted to the grievant and his representative, if any. <br /> c) Nothing contained herein shall be construed as limiting the right of any employee having a <br /> grievance to discuss the matter informally with any appropriate member of the <br /> administration within the chain of command of the Police Department and having said <br /> 6 <br />
