CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015 -46 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE PROVIDING FOR THE SUBMISSION OF AN <br /> AMENDMENT TO THE ELECTORS OF THE CITY OF NORTH <br /> OLMSTED TO ARTICLE VII, SECTIONS 1 AND 4 OF THE <br /> CHARTER OF THE CITY OF NORTH OLMSTED TO <br /> ELIMINATE THE BOARD OF BUILDING CODE APPEALS <br /> (ART. VII, SECTION 1) AND BOARD OF ZONING APPEALS <br /> (ART. VII, SECTION 4) AND TO CREATE A NEW ARTICLE <br /> VII, SECTION 1 BY MERGING THE TWO BOARDS INTO A <br /> NEW`B UILDINGAND ZONING BOARD OF APPEALS,"AND <br /> DECLARING AN EMERGENCY. <br /> WHEREAS,the City Charter establishes a Board of Building Code Appeals and vests with it <br /> the authority to,among other things,hear and decide appeals from any order,decision,requirement <br /> or determination of the Building Commissioner; and <br /> WHEREAS, the City Charter establishes a Board of Zoning Appeals and vests with it the <br /> authority to, among other things, hear and decide appeals for exceptions to and variances in the <br /> application of ordinances, orders or regulations of administrative officials or agencies; and <br /> WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br /> proposal to amend Article VII, Sections 1 and 4 of the Charter of the City of North Olmsted so as to <br /> eliminate both boards in favor of creating a combined Board known as the Building and Zoning <br /> Board of Appeals; and <br /> WHEREAS, this proposal was reviewed and recommended by the Charter Review <br /> Commission in accordance with Article XIV,Section(b)(1)of the City Charter,and the Commission <br /> on the 6th day of May, 2015, filed a written report with the Clerk of Council in which the <br /> Commission stated that,by a 7 to 0 vote, a motion to recommend approval of the proposal passed; <br /> and <br /> WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br /> than 120 days,and no later than 60 days,prior to the date of the election at which the issue will be <br /> voted upon by the electorate. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OF ALL MEMBERS <br /> CONCURRING THAT: <br />
