CHAPTER 949 <br /> Animal Control and Nuisance Abatement <br /> 949.01 Identification of Nuisance Conditions. <br /> 949.02 Right of Entry. <br /> 949.03 Determination of Emergency. <br /> 949.04 Nuisance Declaration and Abatement Order <br /> 949.99 Penalty. <br /> 949.01 IDENTIFICATION OF NUISANCE CONDITIONS. <br /> (a)The Director of Public Safety is hereby authorized to accept information and reports regarding <br /> nuisance conditions arising from vacant or abandoned premises related to animal/pest control from <br /> the following sources: <br /> 1. Health Inspectors assigned by the Cuyahoga County Board of Health; <br /> 2. Building Commissioner or designated real property maintenance officers; <br /> 3. Police Chief or police officers on behalf of the Chief; <br /> 4. Fire Chief or firefighters on behalf of the Chief; <br /> 5. Resident property owners neighboring the alleged nuisance conditions or Council <br /> persons on behalf of such residents. <br /> For purposes of this Chapter, "vacant or abandoned" shall include any residential structure / <br /> premises that is uninhabited or commercial structure/premises that is not presently occupied. <br /> "Nuisance conditions . . . related to animal/pest control" shall refer to animal or insect infestation <br /> in vacant or abandoned residential or commercial structures / premises, including but not limited <br /> to cats, dogs, rats, raccoons, yellow jackets, wasps or other stinging insects. <br /> The Safety Director may determine whether sufficient evidence and documentation has been <br /> supplied and may require additional information to be supplied by reporting agencies or <br /> individuals. The Safety Director shall establish such intake procedure as deemed necessary and is <br /> hereby authorized to conduct such additional investigation as deemed appropriate. The Safety <br /> Director is authorized to declare whether, in fact, a nuisance condition exists, arising from such <br /> vacant or abandoned premises, related to animal/pest control. <br /> (b) In addition to nuisance conditions arising from vacant or abandoned premises related to <br /> animal/pest control,the Director of Public Safety is also authorized to address, declare and initiate <br /> abatement, as necessary, pursuant to Revised Code Section 715.261; in conjunction with the <br /> Building Commissioner pursuant to Sections 1363.108 and 1363.301.3; and pursuant to Chapter <br /> 1373, if applicable. <br />
