Version KW1, 082015 <br /> Exhibit A <br /> CHAPTER 1315 <br /> Board of Building Code Appeals <br /> 1315.01 Jurisdiction. 1315.10 Action on appeals, hearings <br /> 1315.02 Quorum. and reviews. <br /> 1315.03 Disqualification. 1315.11 Decisions: records, filing, <br /> 1315.04 Powers and duties. posting. <br /> 1315.05 Meetings and records. 1315.12 Variations and <br /> 1315.06 Procedure. modifications. <br /> 1315.07 Reports. 1315.13 Building Commissioner to <br /> 1315.08 Appeal to Board. take action. <br /> 1315.09 Time, fee and notice <br /> of appeal. <br /> 1315.01 JURISDICTION. <br /> The jurisdiction of the Board of Building Code Appeals in exercising and performing <br /> those powers and duties set forth in the Charter and in this chapter shall include all matters not <br /> subject to the jurisdiction of the Ohio Board of Building Standards. <br /> 1315.02 QUORUM. <br /> Three members of the Board of Building Code Appeals shall constitute a quorum. In <br /> varying the application of any provision of this Part Thirteen- Building Code or in modifying an <br /> order of the Building Commissioner, affirmative votes of three members shall be required. <br /> 1315.03 DISQUALIFICATION. <br /> No member of the Board of Building Code Appeals shall pass upon any question in <br /> which he has a financial or personal interest. On such appeals or questions in which a member is <br /> disqualified or asks to be excused, the Mayor shall appoint an alternate to fill the temporary <br /> vacancy. <br /> 1315.04 POWERS AND DUTIES. <br /> The Board of Building Code Appeals, subject to the authority conveyed by Article VII, <br /> Section 1 of the Charter, shall have the power to: <br /> (a) Affirm or reverse, in whole or in part, or modify, any decision of the Building <br /> Commissioner interpreting the provisions of this Part Thirteen - Building Code; <br /> (b) Vary the application of any provision of this Building Code to any particular <br /> case, when in its opinion, enforcement thereof would do manifest injustice, <br /> would be contrary to the spirit and the purpose of this Building Code or the <br /> public interest; <br /> (c) Determine if any material or method of construction may be used, even though <br /> not specifically authorized by this Building Code, and specify the manner in <br /> which such materials and methods shall be used; <br /> (d) Determine any requirement for the strength or stability of an existing or <br /> proposed building or structure, or for the safety or health of the occupants <br /> thereof, not specifically covered by this Building Code, or not readily <br /> interpretable from the provisions of this Building Code; <br /> (e) Determine whether any proposed rule of the Building Commissioner <br /> supplements or aids in the interpretation of the requirements of this Building <br /> Code and is consistent therewith, and to affirm, amend, modify or nullify any <br /> such proposed rule; <br />
