CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2015—98 <br /> By: Mayor Kennedy <br /> A RESOLUTION AUTHORIZING THE DIRECTOR OF LAW TO <br /> REQUEST THE COURT TO AMEND THE JUDGMENT ENTRY SO <br /> THAT, AS MODIFIED, THE JUDGMENT ENTRY WOULD PROVIDE <br /> THAT PARCEL 1A (236-11-009) MAY ADDITIONALLY BE USED FOR <br /> HOTEL AND RESTAURANT PURPOSES, SUBJECT TO ALL OTHER <br /> PROVISIONS OF THE JUDGMENT ENTRY AND FURTHER SUBJECT <br /> TO THE PROVISIONS OF THE CITY OF NORTH OLMSTED ZONING <br /> CODE,AND DECLARING AN EMERGENCY. <br /> WHEREAS, Developers Diversified in Case Number 127076 styled <br /> Developers Diversified, et al. vs. City of North Olmsted contested the zoning of real <br /> property parcels located south of I-480 on State Route 252, Great Northern Blvd; <br /> and <br /> WHEREAS, by mutual agreement and judgment entry resolving the <br /> matter, the parties agreed that the first parcel was to developed as multi-family <br /> residential pursuant to the settlement in 1988; and <br /> WHEREAS, in 1992 the parties' jointly requested modification of the <br /> parcel designation map to enable the additional development of the Moen office <br /> building on land previously designated for hotel use; and <br /> WHEREAS, over the past two (2) years, BIW Properties, LLC, affiliated <br /> with Developers Diversified and current owner of the affected parcels, has <br /> prepared, and the City of North Olmsted has reviewed and tentatively approved, a <br /> development plan for the construction of an Aloft hotel and restaurant upon a <br /> parcel presently designated for office use only; and <br /> WHEREAS, it is the opinion of this Council that it is appropriate to modify the <br /> aforesaid judgment entry to reflect therein the city's agreement to permit the change of <br /> uses consistent with this ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND <br /> STATE OF OHIO: <br />
