1) Parcel 1 A, as previously designated for office use only,shall be expanded to also include a hotel <br /> use,with such use and development to be in conformity with the development plan approved by the <br /> City Council of the City of North Olmsted on the day of ,2015 and on file with the <br /> Division of Building in the City of North Olmsted. See also,Exhibit A,attached hereto. The hotel <br /> shall be in compliance with licensing and building requirements in Revised Code Chapter 3731. <br /> The hotel shall be designed, constructed and licensed as a"Transient Hotel" and not as a"Single <br /> Room Occupancy(SRO)"or as an"Extended Stay Hotel" all as defined in R.C. §3731.01(A)(2). <br /> 2) Parcel 1A, as previously designated for office use only, shall be expended to also include a <br /> restaurant use, subject to the conditions set forth herein. <br /> 3) The restaurant component on Parcel l A shall comply with the following: (a)the restaurant must be <br /> a "Restaurant - full service" restaurant as that phrase is defined in North Olmsted Codified <br /> Ordinance Chapter 1115;(b)the restaurant shall not be a"Restaurant-fast food"or"Restaurant— <br /> limited service" restaurant as those phrases are defined in North Olmsted Codified Ordinance <br /> Section 1115; (c) the restaurant shall not include a"drive thru" feature; and (d) the City shall be <br /> consulted in the selection process of a restaurant brand to be located at Parcel 1 A and consent to <br /> that restaurant brand must be secured from the City as part of the development approval process. <br /> Consent shall not be unreasonably withheld. <br /> 4) The restaurant component of Parcel lA shall be subject to compliance with the Court's Judgment, <br /> the Defendant's zoning,planning and development review and approval process,including but not <br /> limited to, the application of zoning regulations in North Olmsted Codified Ordinance Chapters <br /> 1126, 1161 and 1163. <br /> 2 <br />
