CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015— 108 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND <br /> AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT <br /> WITH PHYSIO-CONTROL, INC. TO PROVIDE SERVICE SUPPORT <br /> FOR LIFEPAK MONITORS / DEFIB ULA TORS USED BY THE <br /> DIVISION OF FIRE IN THE CITY OF NORTH OLMSTED, AND <br /> DECLARING AN EMERGENCY. <br /> WHEREAS, Physio-Control is engaged in the business of developing, manufacturing, <br /> selling and servicing external defibrillators/monitors and emergency medical response <br /> products and services; and <br /> WHEREAS, the Division of Fire utilizes Physio-Control, Inc. life-saving equipment <br /> on a daily basis; and <br /> WHEREAS, in years past the City utilized the support services of Physio-Control at a <br /> price less than $5,000.00, avoiding the need for enabling legislation; and <br /> WHEREAS, because this contract is for $7,352.00, it is required by Ordinance to <br /> receive Council approval before execution; and <br /> WHEREAS, Section 112.10(b) of the Administrative Code provides that as an <br /> exception to the RFP process, the City, upon approval of the Council, need not conduct a <br /> formal RFP if the professional services sought are of a continuing nature; and <br /> WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br /> into an agreement with Physio-Control, Inc. for the purpose of providing service support <br /> services for the City of North Olmsted, Division of Fire. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, COUNTY OF CUYAHOGA,AND STATE OF OHIO: <br /> SECTION 1: That the formal RFP process required by Chapter 112 of the <br /> Administrative Code is hereby dispensed with by reason of the ongoing professional services <br /> offered by Physio-Control, Inc. with the City of North Olmsted, and that the Mayor be and he <br /> hereby is authorized to enter into a Contract, said Contract shall be substantially in the form of <br /> the "Technical Service Agreement," marked as Exhibit "A" and attached hereto, with only <br /> such changes therein as are not substantially adverse to the City and which are approved by <br /> the Director of Law.
