CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2015— 115 <br /> By: Mayor Kennedy <br /> A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE A <br /> KUBOTA EXCAVATOR MODEL KX057 AND CAM SUPERLINE TILT <br /> TRAILER AT A COST OF APPROXIMATELY $84,000.00, ALL THROUGH <br /> THE STATE PURCHASE PROGRAM; AND FURTHER AUTHORIZING <br /> THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO <br /> EFFECTUATE SUCH PURCHASE,AND DECLARING AN EMERGENCY. <br /> WHEREAS, the City needs to replace existing, aging excavation equipment; and <br /> WHEREAS, new equipment will better facilitate the cleaning of the City storm ditches; <br /> and <br /> WHEREAS, the Director of Public Service recommends that the City acquire a Kubota <br /> Excavator Model KX057 and CAM Superline Tilt Trailer from Akron Tractor and Equipment, <br /> Inc. at a cost of approximately $84,000.00, as established on the state purchase program; and <br /> WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said <br /> equipment, through the State purchase program, as a permitted exception to the competitive <br /> bidding procedure that otherwise would be required for such expenditures, and to further <br /> authorize the Mayor to execute any documents required for such expenditure, including, subject <br /> to approval of the Board of Control, if necessary, a contract with the lowest and best bidder <br /> selected among State qualified vendors. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, COUNTY OF CUYAHOGA,AND STATE OF OHIO: <br /> SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br /> State Purchasing Program, which was established by R.C. Section 125.04, and which the City is <br /> authorized to participate in pursuant to the City Charter and Resolution No. 87-6, one (1) new <br /> Kubota Excavator Model KX057 and CAM Superline Tilt Trailer from Akron Tractor and <br /> Equipment, Inc. at a cost of approximately $84,000.00, all of which is described in the <br /> specifications on file in the Service Department. If necessary to effectuate any such purchase <br /> through the State Purchasing Program, the Mayor is hereby authorized to execute any contract <br /> and/or other necessary documents required by the authorized vendor(s), the State of Ohio, or the <br /> Charter. Any contract executed by the Mayor shall be in a form and substance consistent with <br /> the provisions of this Resolution and be approved by the Director of Law. <br /> SECTION 2: That this Resolution is hereby declared to be an emergency measure <br /> immediately necessary for the preservation of the public health, safety and welfare, and, <br /> additionally, it is necessary that this Resolution go into effect immediately to lock in the price for <br />
