CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2016 — 3 <br />BY: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AMENDED AGREEMENT WITH LSL PLANNING/SAFEBUILT OHIO, <br />LLC, TO PROVIDE ADDITIONAL PROFESSIONAL PLANNING AND <br />ZONING SERVICES TO THE CITY ON THE ZONING CODE UPDATE <br />PROJECT, AND DECLARING AN EMERGENCY. <br />WHEREAS, in 2015, following a competitive selection process to obtain professional <br />consulting services for the City's Zoning Code Update Project, and after the evaluation of <br />numerous proposals, LSL Planning/SAFEbuilt Ohio, LLC (herein "LSL") was selected and a <br />contract was awarded by the Board of Control; and <br />WHEREAS, the Mayor entered into an Agreement with LSL dated July 15, 2015, to <br />provide professional planning and zoning consultation services to review and recommend <br />updates to the City's Zoning Code; and <br />WHEREAS, LSL has performed in accordance with the Agreement and, by proposal <br />dated November 11, 2015, has outlined additional consulting services in order to develop and <br />draft Zoning Code updates and to otherwise implement City recommendations; and <br />WHEREAS, it is the recommendation of the Director of Law and the Director of <br />Planning and Economic Development, based upon the quality of the consulting services <br />performed to date by LSL, that the City accept additional service offered by LSL; and <br />WHEREAS, it is accordingly the desire of this Council, to authorize the Mayor to <br />enter into an amended Agreement with LSL to provide additional services; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an <br />amendment to the Agreement with LSL Planning/SAFEbuilt Ohio, LLC, dated July 15, 2015, <br />to provide additional professional planning and zoning consulting services to the City. Said <br />amendment shall be in substantially the same form and substance as the Addendum attached <br />hereto as Exhibit A, with only such changes thereto as are not substantially adverse to the City <br />and which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution of the <br />agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to provide for <br />uninterrupted consultation services to accomplish the Zoning Code Update; and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />
