CITY OF NORTH OLMSTED ORDINANCE NO. 2016 —18 BY: Mayor Kennedy AN ORDINANCE REPEALING CHAPTER 765 ENTITLED "RETAIL BUSINESS REGULATIONS" AND ESTABLISHING CHAPTER 733 OF THE BUSINESS REGULATION CODE ENTITLED "TENT SALES & SPECIAL EVENTS" TO PROVIDE REGULATIONS FOR SUCH EVENTS IN THE CITY OF NORTH OLMSTED. WHEREAS, Tent sales and other promotional events have become commonplace in the general retail district as standard marketing practices for many local businesses. This Chapter will establish regulations in response to permit requests from local businesses and protect the health, safety and welfare of the North Olmsted community; and WHEREAS, it is the recommendation of the Administration that the City adopt regulation of Tent Sales and Special Events to reasonably restrict the location and duration of such temporary events; and WHEREAS, it is the desire of this Council to repeal Chapter 765 and enact a new Chapter 733 of the Business Regulation Code entitled "Tent Sales and Special Events." NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That this Council does hereby repeal Chapter 765, entitled, "Retail Business Regulations" of the Business Regulation Code, the substantive provisions of which are now set forth in Section 733.04, Pedestrian Sidewalk Obstructions. SECTION 2: That this Council does hereby adopt Chapter 733, entitled, "Tent Sales and Special Events" of the Business Regulation Code, which reads in its entirety as set forth in Exhibit A and which is attached to this Ordinance and incorporated by reference as if fully rewritten herein. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law.
