CHAPTER 733 <br />Tent Sales & Special Events <br />733.01 Definitions. 733.04 Pedestrian walkway obstructions. <br />733.02 Permit required. 733.99 Penalty. <br />733.03 Duration and frequency. <br />733.01 DEFINITIONS. <br />(a) "Commercial establishment" means any local business, store, warehouse or other <br />mercantile building carrying on a business for profit where commodities are received, <br />exchanged, bought or sold. <br />(b) "Pedestrian walkway" means any clearly defined area on a retail business <br />property that is designed for pedestrian travel and serves to provide pedestrians access to <br />building entrances, parking areas, public sidewalks, or transit connections. <br />(c) "Special event" in this chapter means any event hosted by a local business during <br />which temporary structures such as tents and membrane structures (as defined in the Ohio <br />Building Code section 3102.2), are erected at a commercial establishment for promotional or <br />celebratory purposes. <br />(d) "Tent sale" means any event during which a local business erects a tent or other <br />membrane structure (as defined in the Ohio Building Code section 3102.2) under which to <br />engage in the sale of goods and services at a commercial establishment. <br />733.02 PERMIT REQUIRED. <br />(a) Permit required. Any local business wishing to hold a temporary tent sale or <br />special event at a commercial establishment shall, before the opening of such event, procure a <br />special event permit from the Building Commissioner, which application shall not be made less <br />than ten (10) days prior to the time such activity is to take place. <br />(b) Application. A nonrefundable special event application fee of $25.00 shall be <br />submitted at the time of application. For special events involving the use of tents and temporary <br />structures, additional permit fees are established in Chapter 1321. If a tent sale or special event <br />makes use of a tent having an area of 400 square feet or above, the tent is subject to the Ohio <br />Building Code Section 3102, and must complete the section titled "Tents" attached to the <br />application for a special event permit. <br />733.03 DURATION AND FREQUENCY. <br />No tent sale or special event may run for duration longer than fifteen (15) consecutive <br />days and for a frequency greater than two (2) times in any calendar year. <br />733.04 PEDESTRIAN WALKWAY OBSTRUCTIONS <br />No owner or tenant of any commercial establishment shall store any goods, merchandise, <br />carts or other personal property, or offer for sale or display any goods or merchandise on a <br />pedestrian walkway in a manner that obstructs or unreasonably impairs the use of any pedestrian <br />walkway. For purposes of this section, a pedestrian walkway shall be deemed to be obstructed or <br />its use unreasonably impaired if any goods or merchandise are stored, offered for sale, or in any <br />
