CITY OF NORTH OLMSTED RESOLUTION NO. 2016 — 28 By: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE A NEW GMC SIERRA 1500 PICKUP TRUCK FROM MORRIS CADILLAC BUICK GMC AT A COST NOT TO EXCEED $25,563.28; AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO EFFECTUATE SUCH PURCHASE, AND DECLARING AN EMERGENCY. WHEREAS, the Director of Public Service recommends that the City acquire a replacement vehicle (2016 GMC Sierra 1500 Pickup) for use within the Department of Public Service (Storm / Forestry) from Morris Cadillac Buick GMC at a cost not to exceed $25,563.28; and WHEREAS, although the purchase price falls beneath the mandatory bid amount established by State law of $50,000.00 and is therefore not required to be bid, this price of the vehicle is at, or lower than, the State Purchasing Program price for such a vehicle; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said vehicle and to further authorize the Mayor to execute any documents required for such expenditure, including a contract with Morris Cadillac Buick GMC. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase from Morris Cadillac Buick GMC one (1) new 2016 GMC Sierra 1500 Pickup Truck at a cost not to exceed $25,563.28, all of which is described in the specifications on file in the Service Department. The Mayor is hereby further authorized to execute any contract and/or other necessary documents required to obtain such vehicle. Any contract executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and be approved by the Director of Law. SECTION 2: That Resolution No. 2016-13 authorizing the Mayor to purchase a similar vehicle from Middletown Ford is hereby rescinded. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare of this City, and for the further reason that this Resolution is required to be immediately effective to enable the City to replace vehicles beyond their useful life in a timely fashion; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
