CHAPTER 135 <br />Department of Finance <br />135.01 Establishment <br />135.02 Director of Finance <br />135.03 Secretary to the Director of Finance <br />135.04 Assistant Director of Finance <br />135.05 Authority of other City employees to sign checks <br />135.06 Petty cash fund <br />135.07 Monthly reports required <br />135.99 Composition and Organization of Department of Finance <br />135.01 ESTABLISHMENT. <br />Consistent with Article V, Section 3 of the Charter of the City, there is hereby established <br />a Department of Finance within the City. The staffing of the Department of Finance is hereby <br />established and is reflected in the organizational chart for the Department of Finance contained <br />in Section 135.99, which is incorporated herein as if fully rewritten. The Mayor shall establish <br />the compensation of all employees of the Department within the salary ranges established by <br />City Council, to the extent that such compensation is not otherwise established by contract, or <br />federal, state or local law. <br />135.02 DIRECTOR OF FINANCE. <br />The Department of Finance shall be headed by the Director of Finance who shall hold the <br />position consistent with Article V, Section 3 of the Charter of the City. In addition to all powers <br />and duties of the Director of Finance, as specifically set out in Section 3 of Article V of the <br />Charter of the City, the Director of Finance shall be responsible for and assume the following <br />enumerated duties: <br />(a) Income Tax Administration. <br />(1) The Director shall receive the tax imposed under Part Fifteen - <br />Taxation Code and keep an accurate record thereof and report all moneys <br />so received. The Director shall also be responsible for enforcing the <br />payment of all taxes owing to the City, to keep accurate records for a <br />minimum of five years showing the amount due from each taxpayer <br />required to file a declaration and make any return, or both, including taxes <br />withheld, and to show the dates and amounts of payments thereof. <br />(2) The Director is hereby charged with the enforcement of the <br />provisions of Part Fifteen - Taxation Code and is hereby empowered, <br />subject to the approval of the Board of Review, to adopt and promulgate <br />and to enforce rules and regulations relating to any matter or thing <br />pertaining to the collection of taxes and the administration and <br />enforcement of the provisions of Part Fifteen - Taxation Code, including <br />provisions for re-examination and correction of returns. <br />(3) The Director is authorized to arrange for the payment of unpaid <br />taxes, interest and penalties on a schedule of installment payments when <br />the taxpayer has proven to the Director that, due to certain hardship <br />conditions, he is unable to pay the full amount of the tax due.
