CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 37 <br />By: Mayor Kennedy <br />AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER <br />THIRTEEN OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED TITLED "BUILDING CODE" FOR THE <br />LIMITED PURPOSE OF CHANGING THE "BOARD OF BUILDING <br />CODE APPEALS" TO THE "BUILDING AND ZONING BOARD OF <br />APPEALS" AND DECLARING AN EMERGENCY. <br />WHEREAS, the electors of the City of North Olmsted in November of 2015 approved a <br />proposed amendment to the Charter of the City of North Olmsted to merge the Board of Building <br />Code Appeals and the Board of Zoning Appeals to form a new Building and Zoning Board of <br />Appeals; and <br />WHEREAS, multiple sections of the Building Code make reference to the now abolished <br />Board of Building Code Appeals; and <br />WHEREAS, it is the recommendation of the Director of Planning and Development and the <br />Director of Law that the Building Code be amended to substitute the newly enacted Building and <br />Zoning Board of Appeals for the Board of Building Code Appeals; and <br />WHEREAS, it is the desire of this Council to amend the Code in order to conform with the <br />recent Charter Amendment by amending the Building Code of the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Sections 1317.04(f);1317.05(a); 1319.08; 1347.01; 1347.02; 1347.03; <br />1347.04; 1355.08; 1359.09(c); 1361.03(h); 1361.05; 1363.111.1; 1364.108.1; 1364.108.4; <br />1367.02(d); 1367.09 of the City of North Olmsted Building Code referencing the "Board of <br />Building Code Appeals" shall be amended and, as amended, shall reference the "Building and <br />Zoning Board of Appeals" in their place. <br />SECTION 2: That any reference in the North Olmsted Building Code to the Board of <br />Building Code Appeals not specifically referenced in Section 1 herein shall also be amended to <br />reference the Building and Zoning Board of Appeals instead of the Board of Building Code <br />Appeals. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for that <br />
