CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 39 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTIONS 931.03 AND 931.10 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED, CHAPTER <br />931 ENTITLED "GRADING AND SURFACE WATER DRAINAGE", TO <br />REQUIRE THAT GRADING DEPOSITS FOR SPECIFIED PROJECTS BE PAID <br />AT THE TIME OFAPPLICATION, AND DECLARINGANEMERGENCY. <br />WHEREAS, it is the desire of this Council to amend Chapter 931, Sections 931.03 <br />and 931.10, of the Codified Ordinances of the City of North Olmsted in order to require <br />that Engineering fee deposits be paid at the time of permit application and prior to review <br />of such permit applications, consistent with comparable codified fee deposit procedures <br />in the Division of Building. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 931 "Grading and Surface Water Drainage" at Section <br />931.03 and at Section 931.10, which presently reads in its entirety as set forth in Exhibit A, <br />which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, <br />shall be amended and, as amended, shall read in its entirety as such amendments are highlighted <br />and displayed in Exhibit B. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent <br />with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for that <br />reason this legislation must go into effect immediately in order to update the procedure before the <br />summer construction season commences; and further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />PASSED: J W 6 <br />First Reading: LIkAwmIr <br />Second Reading: <br />Third Reading.• <br />Committee: S�tr_�$ <br />
