CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2016 — 53 <br />By: Mayor Kennedy <br />A RESOLUTION DECLARING THE NECESSITY AND INTENTION OF <br />THE CITY OF NORTH OLMSTED, OHIO, TO APPROPRIATE A FEE <br />SIMPLE INTEREST IN 5.439 ACRES OF PROPERTY, IDENTIFIED AS A <br />PART OF PERMANENT PARCEL NOS. 232-23-021 AND 232-23-022, AND <br />LOCATED ON VACANT LAND OWNED BY THE NORTH OLMSTED <br />BOARD OF EDUCATION, FOR THE PUBLIC PURPOSE OF <br />CONSTRUCTING STORM SEWER MANAGEMENT AND DRAINAGE <br />SYSTEMS, INCLUDING SEWERS, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted intends to acquire 5.439 acres of land, part of <br />Permanent Parcel Nos. 232-23-021 and 232-23-022, located on vacant land owned by the North <br />Olmsted Board of Education ("School District"), for the public purpose of constructing storm <br />water management and drainage systems, including sewers; and <br />WHEREAS, the Mayor has directed and the Service Director and Engineer have <br />identified strategic locations in the City for the construction of storm water management systems <br />and sewers to improve the City's infrastructure and combat residential flooding in North <br />Olmsted; and <br />WHEREAS, the City has conceptual drawings for general specifications prepared for <br />bidding of a public improvement project known as "Pine Drainage Basin Improvement Project" <br />to be constructed on said 5.439 acres of land, including retention systems, drains and sewers, <br />designed to improve storm water drainage generally, and especially in the immediate vicinity; <br />and <br />WHEREAS, the Project area is and has historically served as a natural stream and <br />drainage ditch for storm water drainage and is well situated and an ideal location for the <br />proposed storm water retainage system, and dramatically increases the capacity of the system, <br />without undue burden, expense or interference with the School District's land usage; <br />WHEREAS, the Mayor has, since the Fall of 2015, communicated with the School <br />District to discuss the property appropriation, offered cooperation with and respect for School <br />District property uses and future development, but the School District has not agreed through <br />negotiation of a purchase price; and <br />WHEREAS, on October 6, 2015, this Council adopted Resolution 2015-94, which is <br />incorporated herein by reference, describing the Project and authorizing the Director of Law to <br />commence Eminent Domain proceedings against the North Olmsted Board of Education to <br />
