simple interest in the said 5.439 acres of vacant land for the public purpose of storm water <br />drainage systems and sewers referred to as the "Pine Drainage Basin Improvement Project". <br />SECTION 3: That the Clerk of Council of the City of North Olmsted is authorized and <br />directed to deliver certified copies of this Resolution to the North Olmsted Board of Education <br />and to each person having an interest of record in any of the said parcels of real property, or to <br />the authorized agents of those persons. <br />SECTION 4: That it is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Resolution were taken at meetings of this Council <br />and of its committees, if any, which were open to the public in compliance with law. <br />SECTION 5: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that this legislation must go into effect immediately in order to: (1) expedite the <br />acquisition of real estate vital to the creation of a storm water detention basin to prevent <br />additional storm water flooding; (2) to mitigate financial losses experienced in basement flooding <br />events; and (3) and to further avoid the extreme emotional toll that flooding events can have <br />upon our Residents; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: (%'Wc- 4vl <br />l <br />ATTEST: <br />MARIE G LL <br />Clerk of Council <br />APPROVED: 5-�_?
