simple interest in the said 5.439 acres of vacant land for the public purpose of storm water drainage systems and sewers referred to as the "Pine Drainage Basin Improvement Project". SECTION 3: That the Clerk of Council of the City of North Olmsted is authorized and directed to deliver certified copies of this Resolution to the North Olmsted Board of Education and to each person having an interest of record in any of the said parcels of real property, or to the authorized agents of those persons. SECTION 4: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were taken at meetings of this Council and of its committees, if any, which were open to the public in compliance with law. SECTION 5: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that this legislation must go into effect immediately in order to: (1) expedite the acquisition of real estate vital to the creation of a storm water detention basin to prevent additional storm water flooding; (2) to mitigate financial losses experienced in basement flooding events; and (3) and to further avoid the extreme emotional toll that flooding events can have upon our Residents; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
