Final Draft 050316 <br />CHAPTER 735 <br />Food Trucks <br />735.01 Definitions <br />735.02 License required for operation; <br />735.03 Operation in right of way; <br />public property <br />735.04 Products for sale <br />735.05 Restrictions on hours of <br />operation <br />735.99 Penalty <br />735.01 DEFINITIONS. <br />(a) "Food Truck" means any vehicle or vehicle and trailer combination licensed by the State <br />of Ohio and possessing a Mobile Food Vending License. The term "Food Truck" shall exclude "Frozen <br />Dessert Peddlers" as defined in 737.01. <br />(b) "Mobile Food Vending License" means the official document issued by the Cuyahoga <br />County Board of Health allowing the operation of a mobile food establishment in Cuyahoga County. <br />735.02 LICENSE REQUIRED FOR OPERATION. <br />(a) No person or organization shall offer for sale any food or beverage from any vehicle or <br />vehicle and trailer combination within the City of North Olmsted without a current and valid Mobile Food <br />Vending License issued by the Cuyahoga County Board of Health. <br />(b) A Mobile Food Vending License must be clearly displayed on the vehicle during all <br />times of operation. <br />(c) All Food Trucks shall be subject to inspection during operation by the Division of Fire <br />for compliance with local and state fire code regulations. <br />735.03 GENERAL REQUIREMENTS. <br />(a) All Food Trucks operating in the City of North Olmsted must keep the area immediately <br />adjacent to the Food Truck clean and must make arrangements for disposal of all trash generated from its <br />operation. <br />(b) No Food Truck shall utilize loud speakers or other noise -making devices. <br />735.04 OPERATION IN RIGHT OF WAY; PUBLIC PROPERTY. <br />(a) Food Truck operators are prohibited from selling any food or beverage in the public right <br />of way unless in conjunction with a community event as permitted in Chapter 177 or a block party as <br />permitted in Chapter 311. <br />(b) Food Truck operators are prohibited from selling food or beverage on public property, <br />including public parks, without prior written authorization from the Director of Public Service. <br />735.05 PRODUCTS FOR SALE. <br />Food Truck operators may only sell food and/or non-alcoholic beverage products. <br />735.06 RESTRICTIONS ON HOURS OF OPERATION. <br />Food Trucks positioned within 250 feet of a lot occupied by a one or two-family residence may <br />not operate between the hours of 10:00 p.m. and 7:30 a.m. <br />735.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a fourth degree misdemeanor. <br />
