CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 47 <br />By: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 926.15(c) OF CHAPTER <br />NINE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED TITLED "STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE" FOR THE LIMITED PURPOSE OF CHANGING <br />THE `BOARD OF BUILDING CODE APPEALS" TO THE <br />"BUILDING AND ZONING BOARD OF APPEALS" AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the electors of the City of North Olmsted in November of 2015 approved a <br />proposed amendment to the Charter of the City of North Olmsted to merge the Board of Building <br />Code Appeals and the Board of Zoning Appeals to form a new Building and Zoning Board of <br />Appeals; and <br />WHEREAS, section 926.15(c) of the Streets, Utilities and Public Services Code makes <br />reference to the now abolished Board of Building Code Appeals; and <br />WHEREAS, it is the recommendation of the Director of Planning and Development and the <br />Director of Law that the Streets, Utilities and Public Services Code be amended to substitute the <br />newly enacted Building and Zoning Board of Appeals for the Board of Building Code Appeals; and <br />WHEREAS, it is the desire of this Council to amend the Code in order to conform with the <br />recent Charter Amendment by amending the Building Code of the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 926.15(c) of the City of North Olmsted Streets, Utilities and <br />Public Services Code referencing the "Board of Building Code Appeals" shall be amended and, as <br />amended, shall reference the "Building and Zoning Board of Appeals" in its place. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for that <br />reason this legislation must go into effect immediately in order to comply with Charter <br />Amendments currently in effect; and further provided it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />
