CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 49 <br />By: Mayor Kennedy <br />AN ORDINANCE AMENDING VARIOUS SECTIONS OF PART <br />SEVEN OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED TITLED "BUSINESS REGULATION CODE" <br />FOR THE LIMITED PURPOSE OF CHANGING THE "BOARD OF <br />BUILDING CODE APPEALS" AND "BOARD OF ZONING <br />APPEALS" TO THE `BUILDING AND ZONING BOARD OF <br />APPEALS" AND DECLARING AN EMERGENCY. <br />WHEREAS, the electors of the City of North Olmsted in November of 2015 approved a <br />proposed amendment to the Charter of the City of North Olmsted to merge the Board of Building <br />Code Appeals and the Board of Zoning Appeals to form a new Building and Zoning Board of <br />Appeals; and <br />WHEREAS, multiple sections of the Business Regulation Code make reference to the <br />now abolished Board of Building Code Appeals or Board of Zoning Appeals; and <br />WHEREAS, it is the recommendation of the Director of Planning and Development and the <br />Director of Law that the Business Regulation Code be amended to substitute the newly enacted <br />Building and Zoning Board of Appeals for the Board of Building Code Appeals or the Board of <br />Zoning Appeals; and <br />WHEREAS, it is the desire of this Council to amend the Code in order to conform with the <br />recent Charter Amendment by amending the Business Regulation Code of the City of North <br />Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 755.06 of the City of North Olmsted Business Regulation Code <br />referencing the "Board of Building Code Appeals" shall be amended and, as amended, shall <br />reference the "Building and Zoning Board of Appeals" in its place. <br />SECTION 2: That Sections 721.08, 752.03(c), 752.08(d)(2) and 752.12(d) of the City of <br />North Olmsted Business Regulation Code referencing the "Board of Zoning Appeals" shall be <br />amended and, as amended, shall reference the "Building and Zoning Board of Appeals" in their <br />place. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />
