CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 56 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 561 <br />OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED "CRIMINAL ACTIVITY NUISANCES" IN ORDER TO <br />INCLUDE COMMERCIAL PROPERTY IN SAID CHAPTER, AS <br />A MEND n.. <br />WHEREAS, the City of North Olmsted, by and through Ordinance 2008-62, established <br />Chapter 561 in order to develop a program for the declaration and abatement of nuisance <br />activities, on residential properties only, in order to hold owners accountable for the enforcement <br />costs incurred by the City and to otherwise require action by the owner to control the unlawful <br />activities of tenants; and <br />WHEREAS, the City of North Olmsted, by and through Ordinance 2010-50, established <br />Chapter 1373 in order to develop a program for the declaration and abatement of nuisance <br />activities, on both residential and commercial properties, in order to hold owners accountable for <br />the enforcement costs incurred by the City and to otherwise require action by the owner to <br />control the unlawful activities of tenants; and <br />WHEREAS, Chapter 1373 incorporates Chapter 561 by reference and thereby includes <br />but is not limited to criminal nuisance activities; and <br />WHEREAS, the Directors of Law and Public Safety recommend that Chapter 561 be <br />amended to include both residential and commercial properties so that, by adopting this <br />amendment, Chapter 1373 will thereby also include the abatement of criminal nuisance activities <br />on commercial properties. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 561 "Criminal Activity Nuisances" which presently reads in <br />its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety <br />as set forth in Exhibit B, which is likewise attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance shall take effect and be in force from the earliest <br />period allowed by law upon its passage and approval by the Mayor. <br />
