CITY OF NORTH OLMSTED ORDINANCE NO. 2016 — 56 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 561 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED "CRIMINAL ACTIVITY NUISANCES" IN ORDER TO INCLUDE COMMERCIAL PROPERTY IN SAID CHAPTER, AS A MEND n.. WHEREAS, the City of North Olmsted, by and through Ordinance 2008-62, established Chapter 561 in order to develop a program for the declaration and abatement of nuisance activities, on residential properties only, in order to hold owners accountable for the enforcement costs incurred by the City and to otherwise require action by the owner to control the unlawful activities of tenants; and WHEREAS, the City of North Olmsted, by and through Ordinance 2010-50, established Chapter 1373 in order to develop a program for the declaration and abatement of nuisance activities, on both residential and commercial properties, in order to hold owners accountable for the enforcement costs incurred by the City and to otherwise require action by the owner to control the unlawful activities of tenants; and WHEREAS, Chapter 1373 incorporates Chapter 561 by reference and thereby includes but is not limited to criminal nuisance activities; and WHEREAS, the Directors of Law and Public Safety recommend that Chapter 561 be amended to include both residential and commercial properties so that, by adopting this amendment, Chapter 1373 will thereby also include the abatement of criminal nuisance activities on commercial properties. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 561 "Criminal Activity Nuisances" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and incorporated by reference as if fully rewritten herein. SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re -codification. SECTION 3: That this Ordinance shall take effect and be in force from the earliest period allowed by law upon its passage and approval by the Mayor.
