CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2016 — 57 <br />BY: Mayor Kennedy and Council Members Williamson & Brossard <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PLANNING <br />& DEVELOPMENT TO SOLICIT BIDS FOR THE DEMOLITION <br />AND REMOVAL OF DANGEROUS BUILDINGS LOCATED AT 5261 <br />BERKSHIRE DRIVE AS A PUBLIC NUISANCE, AND FURTHER <br />AUTHORIZING THE COSTS TO BE CERTIFIED AS A TAX LIEN <br />UPON SAID REAL PROPERTY PURSUANT TO SECTION 1331.05 <br />OF THE CODIFIED ORDINANCES, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Building Commissioner has determined that the buildings <br />located at 5261 Berkshire Drive, North Olmsted, OH 44070 are both dangerous and <br />constitute a public nuisance as defined by NOCO §1363.108 and 1364.107 and, due to <br />the extensive deterioration of these vacant and unsafe structures, has ordered demolition <br />and removal thereof to abate the nuisance; and <br />WHEREAS, the Building Commissioner has, in accordance with NOCO <br />§1363.108.2 and 1364.107.1, issued notification to the property owner, lienholders or <br />others having an interest in said property as to the determination of dangerous buildings, <br />existence of nuisance conditions and ordered abatement by demolition; and <br />WHEREAS, although notified in accordance with law, said property owner, <br />lienholders and others having an interest have failed to comply with said <br />repair/demolition Order for more than sixty (60) days, have not otherwise objected to the <br />demolition Orders, and have failed to appeal from the determination of Building <br />Commission; and <br />WHEREAS, it is the desire of this Council, in accordance with NOCO § <br />1363.108 and 1364.107, to cause the dangerous buildings located at 5261 Berkshire <br />Drive in the City of North Olmsted to be demolished and removed in order to abate the <br />public nuisance arising therefrom and to further cause the costs of demolition and <br />removal to be certified and placed upon the tax duplicate of the premises as a lien upon <br />said premises; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning and Development be and she is <br />hereby authorized to proceed with, arrange for, and initiate all reasonable measures, <br />either directly or through the Building Commissioner, to solicit bids for demolition and <br />removal of all dangerous buildings located at 5261 Berkshire Drive, City of North <br />Olmsted, based upon demolition Orders issued pursuant to Chapters 1363 and 1364 of the <br />
